The police car initially parked, followed me for 5 minutes before pulling me over for slow driving. I knew he was pacing me and didnt want to get stuck with speeding. I was going exactly 5 under because it was 2AM and I was lost. There was a point where it was 45 and I thought it was 35, but only briefly. I received a provisional DWI, G.S 20-138.3. The police investigation report left out all details, but marked "yes" to drugs, instead the factual "unknown" option. I blew a 0 on a breathalyzer, and was given no controlled substance test. I was detained for 30 minutes and additionally had a field sobriety test. The flashing lights where left on the entire time and I had their flashlights in my eyes, thus impairing my sight. I also wasn't wearing my glasses, was tired, cold, and had to pee.

I was caught under DUI on April , hired attorney but he cheated by fake commitment and keep taking new court dates, now I hired a new attorney but i have to go back my home country fro six month my attorney tried to extend the case for 6 month but DA refuse to do so , My attorney is saying it will be decided on next court date on 12/09 and I need to fly on 12/14 My question is how good chances are Judge will extend court date for six month i have given bond of 15000 $ and ready to give all proofs. I went in front of a judge for a DWLR and asked for a PJC. My charge of Resisting a Public Officer was dismissed by the prosecutor. The judge denied my PJC. He then said he is sentencing me to a maximum sentence of 45 days because I cursed out the police officer and was laughing during sentencing. Can I challenge it?
