Got pulled over leaving a plaza with a bar. Cop was watching the plaza and reported that I had rolled through a stop sign and a stop light (right on red). Pretty certain there was no roll thru on the stop sign (may have stopped just past the white line), stop light I stopped but probably wasn't for 2 seconds or whatever is required. Pulled me over a couple of miles later. Said he smelled alcohol, asked me to take field sobriety, I refused b/c I believe the tests are biased. Also refused the breathalyzer. Cop is a leading DUI cop, so he is thorough. I likely would've been close, either just under or just above legal limit. This is my first offense, clean record, was wondering the likelihood charge will be reduced or dropped and get license back w/ a good attorney despite implied consent.
Big difference between stop sign and stop light. Stop light allows you to pass the "stop bar" (white line on the road)...
my friend lives in north carolina and wants to move down here without finishing there probation. can the state of florida do anything to them? his time to serve would be only 30 days if he choose not to do probation.. it is nothing to serious but could florida arrest or charge him or do anything for that matter?
Once he finishes his obligations to North Carolina then Florida will not have an issue. But that is assuming he clears...
I have a question regarding lockouts. I drank the night before, pretty late into the night and for the first time in awhile. The next day, around two, I got into my car and received my first red light lockout (5 minutes). I spent the next 40 minutes; 1. Trying to get a hold of my officer (no luck), 2. Talking to the interlock people (no help) and 3. Drinking water like my life depended on it. Finally, around 2:40, got back into my car, blew, got a yellow caution light prompting me to start my motor. I had 3 rolling pretests on my way to work, all of which came back yellow. I have done a fair amount of work in my pretrial checklist, I am three months into my interlock sentence, and this was my first lockout. Does anyone know where I might be standing in terms of penalties?
It's simple, if you are drunk you should not drive. As someone who was hit by a drunk driver many years ago I can tell...
I was pulled over in Cumming GA, I pulled right into a parking lot on the right. The officer came up to the van and asked where I was going. I complied with everything, he had me do the field sobriety test three times. I asked repeatedly why he was doing it, on the last test the eye exam he made me take off my glasses (it says on my license and I told him I couldn't see) he arrested me and said it was a DUI since he smelled alcohol in the van. His police report has two different streets than on the tickets, his report said I had no DL but he checked it into the jail, and he did not record any of it. I was not read any rights, and I will lose my job as a worker with at risk kids. Ive presented articles and maps to show proof and it is all being ignored. This will be on my record for 65yrs
You need to hire an attorney. It sounds like there are a lot of problems with the state's case and an attorney can...
i have a friend who recently got picked up for a DUI while on probation for 2 counts simple battery. he is a habitual offender, what can we expect?
It is hard to answer this question without more specifics and without knowing the jurisdiction of where these incidents...
Over 25 years ago I was arrested for a DUI in Mecklenburg Co, NC. I had a drivers lic. up until Jan 2005. I went to renew my lic. and found it suspended due to the DUI. All of the fines were paid, but I have a failure to appear and a warrent was issued. I now live in another state and I would like to get my lic back. Due to my work schedule and available funds, I can't afford to go there and am concered about being put in jail for this. Is there anything I can do? Please advise.
It is possible to resolve this without going there while there is a warrant outstanding against you. Of course, if you...
told the judge I never had the first one she said how can she trust me I said because I was under oath
You request proof of first conviction. State must prove first conviction and they will do that by obtaining a...
