Arrested in clay county Missouri for dui, bac of .18 and going 60 in a 45. I need to know if this is my second offense, could it be a felony? Does it have moral turpitude? And could it be a aggrevated dui?

I have a job, kids, I'm the scout leader etc. I haven't been in trouble since I got my last one in college. My current attorney says i have to take the felony charge and spend a month in jail. In Missouri on 10/05/14 I was in a parking lot of a motel when police pulled in and utimately took me in at approximately 1:30 or so am. Several civial rights of mine were abused. I was charged I thought with a DWI according to the county court there are no charges pending a court date as of yet 1/11/14. I instanty moved forward with a restricted licence and satop as well as the interlock. I called the licence bureau interactive response hotlime and it states I have no pending or action against my license. My question is can i legally remove this interlock or do I just leave it on for the 6 months. I am not trying to bring any attention to myself and I am seeing the statue of limitations to be one year if I am correct. Any advise is appreciated. Thank you very much

I was homeless for a while and had fell asleep in my vehicle. It was freezing outside so the vehicle was running. The police came and woke me up, and had me do field sobriety tests. I passed 3 before I had to do the stand on one foot and I even told them I had poor balance, especially since I just woke up. Well, she failed me and placed me under arrest. When we got to the police station, she had me perform the same tests all over again, passing all but the balance test and Gabe me a ticket for a DUI and the released me. I even informed them I was homeless. Can the legally arrest and ticket me for a DUI?

I was locked outside of my vehicle, which was out of gas. I was trying to get in the back window when a police officer pulled up. He ordered me to back away from my vehicle and I explained that my keys were locked inside. He popped open my door, removed my keys that were in the passenger seat and ordered me to perform some sobriety tests. I obeyed since he told me my license would be automatically revoked for 1 year if refused. I did 2 or 3 tests before I had to do the one where I stand on one foot. I even told him I had poor balance regardless, I was naturally clumsy, having a bit of humor but truth. I failed that test and he immediately wrote me a ticket and handcuffed me and took me to jail for a 12 hour detox. He never made a traffic stop, can he legally charge me with a DUI?
