Putnam County NY Had the above reduced to a class U misdemeanor on 10/2012. However after applying for safety sensitive positions I just found out that the above data base is showing the class E felony 10 months after the reduction of sentence I have picked up a copy of the Uniform sentence and commitment and it shows the Felony vacated to the Class U misdemeanor.
You cannot purge a felony, especially in privileged data banks.
My friend, he's 20, was really drunk and he blacked out in someones house down the road. The people living there found him in the morning and didn't know him so they called the police and pressed charges for breaking in. He has no idea how he got there. My 28 year old son was arrested for the second time for DWI in NY. First time pled to impaired 4 years ago. He works full time and grosses $500 per week. We were told he did not qualify for legal aid because he works. He also has mental problems for years but refuses to go to a psychiatrist or doctor. Questions 1. If he quits, would he then qualify 2. If he gets fired would he qualify 3. He has mental problems and refuses to go to a doctor and my wife and I have been dealing with this for 12 years. Is there a way an attorney can ask the judge or D.A. to have him evaluated and if so, have it made part of a conviction ?

on 4/15/2012 I was on Taconic State Parkway in Putnam Valley on my way back to brooklyn,NY from windsor,CT i ran out of gas on Taconic State PArkway. Two officers then approached the car asked what the problem was i told them i ran out of gas, They asked me to step out of the vehicle and gave me the standard DWI test. I was arrested and taken to Troop K in salt point,NY where i was given another test where my BAC came out higher than .18 i was charges with Driving while intoxicated, and Aggravated DWI- Blood Alcohol Content .18 or higher.

The law had just changed on Jan-1,st five years ago, a dui with in ten years apart was considered a felny. I was just under the limt. I through away my copy of the arresting officer's hand written supporting deposisition .One of the officers asked me and the arresting officer for a copy of the dposn. The DA ;judge or my P D had a copy.After quite a while I felt I should not have,,, but I pled guilty. Things got confusion, I felt sure the most important thing in LAW was what was written onstone. My public defender was going to hand my case over to a ex DA who sed to me the deposision was very important . In between bad weather, a short three way conversation with ex DA and the investigator for the PD,I went before the Judge and pled guilty. one very GOOD thing of all this is four yrs sober

This is my 2nd DWI in NY in 5 years and I am looking at a Class E felony. I already have had my license revoked and I am facing jail time. I blew a .28 which is aggravated, there is a witness testimony and video evidence and self admission. I know I am screwed and I know I have to face whatever charges I am brought to. I have had a great job for over 7 years. I've been attending college and I have been blessed to have been able to keep my job even though all of this is going on and my license is revoked. I have never had a felony in the past and I am in fear I will spend years in prison. I know if I go to trial I will lose given all the facts mentioned above. I am looking for an honest opinion and advice. I'd like a lawyer that actually cares for my future and not just my money.
You are probation eligible even if you plead to the felony. A lot depends on the attitude of the Judge and or the DA....
