My daughter recently had a misdemeanor DUI in Hamilton County, Indiana and was given a suspended sentence and currently on one year probation. The terms of her probation include no alcohol consumption of any kind. I still find my daughter testing this and continuing to drink, and I want to be able to give her the facts on what will happen if she is randomly tested and found to have alcohol in her system. Also, is it known if the test they use is a EtG test (my research has shown these may be deemed unreliable, but can show alcohol for up to 80 hours) or a standard ethyl alcohol test? I think more hard FACTS may help convince her to follow her guidelines.
If the fear of jail is not enough to get her to flee alcohol, she is probably addicted. I know if I was arrested and...
I was sentenced to 6 months of probation back in mid December in a different county than the one I live in, misdemeanor offense. I met with the probation officer immediately who told me that he was transferring my case to the county I live in and that they would contact me within a few weeks. It has been a few days over a month since then and I haven't received anything, not a letter or call even though they have all of that information. I'm about 2 months into the probation period in about a week. Do I need to be concerned about anything? Should I be actively seeking out someone to talk to or do they just have more important cases to worry about? I contacted the probation office in my county and they haven't received anything at all about me or my case from the prosecuting county yet.
In a situation like this, it is always better to be proactive. I would contact the probation office in the county of...
After getting charged with OWI I agreed to a plea deal in which I was ordered to complete one year of probation and 24 hours of community service while my license was suspended for 180 days. Probation meetings went very well for the first couple months, but then I missed one and was afraid of the consequences so I missed another and another... I never did go back or have contact with the court or probation officer, and they have not tried to contact me. Almost two years have passed since this and it is really weighing on my conscious. Also, I tried to get my license back, but the BMV says it is suspended for "Failure to Appear for Driver Safety Program" which I was unaware that I had to do. What are the probable/possible consequences I may face if and when I contact the court/probation?
You should contact a criminal defense lawyer to help you with your situation. It is probable that your probation...

Your answer requires the assistance of a Domestic Relations(Divorce) lawyer.I do not practice in Indinana, but call the...
I was recently arrested for a DUI out of the state of Indiana, where I have been accepted to medical school. I had previously submitted a criminal background check and was clean but that was before the charges were filed. I anticipate on entering into a diversion program that will expunge these records in 12 months. Am I required to disclose this information before matriculation, and if so will this be grounds for dismissal?
This is not really a legal question. It would be dictated by the relationship between you and the university. If they...
I have a 2 year suspension for refusing the breathalyser but they did give me a blood test. Also 6 month suspension for the DUI. No other driving charges in the past five years. I have completed the alcohol program for my probation. I still have three months left of probation.
I am not sure why you got 2 years for the refusal unless you had a prior conviction for OWI. Assuming that is the case...
