An uninsured drunk driver veered off the roadway hitting a tree then slid into the fence kicking up rocks, gravel and mud breaking the window and tail light as well as damaging the paint all while my car was parked outside of the body shop waiting to be repaired. I know, right? The shop called their insurance and were told that vehicle was damaged by another vehicle and should be handled by the auto insurance companies and in this case, under an uninsured motorist claim. I filed a claim with my ins. co and was later notified by the claim rep that I did not have comp/collision coverage therefore they could not handle the claim stating because I wasn't in the car, the claim becomes comprehensive. Am I really going to have to pay/sue for this? Should the body shop or their property ins pay?

Arrested for DUI but DA refused to prosecute. Prelim BAC tests were .076 and .078. Then about 30 minutes after driving, the BAC tests were .08 and .08. I was witness and several errors in chp report that dmv relied upon. Admin review just rubber stamped finding that "driver was at .08 while driving" . Blatantly untrue! If no court conviction, is First offender DUI class required to get restricted license to drive to work or to get regular license when suspension period ends? I was pulled over for swerving on Dec. 6th 2010. When the officers approached my vehicle they demanded that I perform a field sobriety walk test. I am disabled and cannot walk without a walker which was in my vehicle. The officers had me submit to a Breathalyzer which showed 0.0% since I do not drink. They then demanded that I walk with one leg behind the other even after I told them I was disabled and had my walker in the vehicle. After test they stated that I performed horrible and had to carry me to their vehicle which is in the written report. I hired a attorney and he has requested the audio/video footage since 2010 and 2 + years later I am still waiting. I live on my own and I dont have anyone to drive me to the grocery store. Surely I have to eat. And in order to keep my jobs I need to be able to drive to the store to pick up laundry detergent and other personal items. Also, what about going to the doctor or the pharmacy?
