As a part of a conditional discharge "a friend" was required to install and utilize an ignition interlock device. There was no requirement to abstain from alcohol. No condition stated that one could not receive a positive reading on the device, only that it must be installed, not be tampered with, and no other car could be driven. However, at the end it stated that "failure to comply with any of the above conditions or any attempt to start or operate a motor vehicle after consuming alcohol" would cause a violation. But if one has no intention to start the vehicle (they just want to see if they have a low enough BAC to drive), would this constitute a violation? Would intent to start or operate the vehicle be presumed? Is "after consuming alcohol" too broad?

long story short;jan 20 i was charged with reckless driving per an anonomous tip,i failed several sobriety tests and they got a blood sample, 50 days later they called me to come in and charged me with the dwai,i admitted to having taken my presciption meds and that was why i was "impaired",true but one thing i did not say is that i had also taken a nonprescribed atavan.i got a letter a few days ago saying that if i sign a waiver to the speedy trial and get an evaluation from the county dwi assessment office that i have a chance to have these charges reduced.i am really poor so i have to go to my first court date unrepresented .what should i do is my question , i dont want to be put in jail because i am a single dad with a 5 year old daughter and i know i screwed up ,any advice would be a

hospital for a blood sample and had my van impounded and took me back to the station . . they kept me there for an hour then let me go , giving me a ticket for reckless driving . i was polite and respectful the whole time . i have 3 prior dwai's over ten years ago . i am on controlled substance prescription meds and took a little diazapem that day that i am not prescribed . . i am very worried . my court date is on April 9 , and i haven't heard anything further . what is going to happen to me and what are my options for defense ?

This morning as I was about to leave for work , I blew into my Ignition Interlock device and it registered as a fail . 5 minutes later , it asked me to blow again and it failed a 2nd time . I am locked out for 4 days for service . I had to have my father pick me up and take me to work because I didn't want to risk having any more failed start - up attempts ; on the ride to work , we discussed what could possibly have triggered a false positive . I have not had a sip of alcohol since my arrest ( AggDWI ) , which was over a year ago . So many of my household items contain alcohol , from mouthwash & whitening strips , to cologne & body spray . Perhaps these caused it , but I'm sure the courts will believe their machine over the " drunk " . I'm NOT on probation ( cons . discharge ) . I appreciate any help .
There appears to be a malfunction with the ignition interlock device itself. You will have to get the device serviced....
