My boyfriend and I got into a fight while in California. I was extremely intoxicated and don't remember most of the details. He was arrested for domestic violence based on statements I made. I don't remember what statements I made to the police and not sure why they charged him. We are Ohio residents and I really don't want him going to court for something I can barely recall. He has no previous history of abuse and has never done anything to me before. Do I have any way to stop the DA from prosecuting?
California will admit any statement as evidence if it was voluntarily given. The question as to whether it is a true...
I got my dui last night at 6 am because my car was parked on the side of a suburban road, asleep, with light vomit on my clothes. I don't remember stepping into the car and I don't remember taking a blood test but I scored a really high blood alcohol content level, that I was to the emergency room. Should I plead no contest or get a lawyer?
You should hire an attorney or apply for the public defender. Even as a juvenile an OVI can carry serious consequences....
This would have been my third DUI (First in 2001 in California, Second in 2003 (2 months prior) in Ohio). I was arrested and given an OR, but never went to court. Instead I moved back to California to go to rehab, had some more struggles, but have been sober since 2006. I haven't had a DUI since. DMV in California has given me my license back, but they claim I need to clear up this charge in order to renew my license. I no longer have any ties to Ohio (I was only there for college), and live a completely different life now. I know that I need to clear this up for many reasons, but I don't even know where to approach it,being that I live out of state. Do they do alternative sentencing for people who live and work out of state? Also have a failure to pay fines warrant from prior dui.
The only good option is for you to hire an attorney near where the charge is pending who can file an appearance and try...
I got charged with a 2nd OVI after I swerved to miss a deer and struck a guardrail, my vehicle was totaled and another car stopped to help me. I wasnt drunk but I was very "out of it" from the accident as it was pretty bad. I did hire an attorney, but was wondering if there was anyway to avoid Jailtime or the hefty license suspension?
I could give you all sorts of scenarios and I understand that you are worried about the outcome. But the only person...
I was pulled over and arrested for a DUI and refused to submit to a chemical test. This was my second refusal in 6 years. The case ended up getting dismissed because the officer had no lawful reason to pull me over. However, my license is still under suspension by the BMV because it was the second time I refused a chemical test. I know my lawyer can petition the BMV to drop the suspension, but what are the chances of the BMV actually dropping it when the charge was dismissed?
I'm not licensed in OH so I recognize differences in the laws and procedure in our neighboring states may result in...
