I was in a single car accident back in May. I was avoiding a potential head on collision and I lost control of my car. I went
off the road hitting a tree and rolling ove landing upside down. The car behind me stopped, got me out and police came. He called EMS. He tried to give me a breath test, but the glass that I had in my mouth made it impossible to blow( even though I did try 3 times). I was not seen on video and was not given a blood test. I was transported to the hospital and was released 3 hrs later. I was chared with DUI due to the smell of alcohol on my clothes from working in the bar that night. I've gone to court once and was delayed to another date. I didn't get the public defender because I thought I could save enough for an attrny, but don't have it. What will the judge do this time and can I ask for more time? Also, can I receive any additional charges when my ticket just says dui?

My close friend is going to court in the morning for his 4th DUI. I do not know his prior legal arrangements regarding his other DUI cases. He is planning on pleading not guilty in the morning so that he can have a trial, to obtain time to seek better council due to the fact that he only blew a .09 and the legal limit here in KY is .08. The defense was told that the arresting officer was on administrative leave and that this held no relevance to the case. As it turns out his credibility is in question and the story broke on the news the night of the guilty plea. If all information was given to us in this case we would have went to trial but due to the advise of the defense and the information being withheld we were misled and duped into pleading guilty.

I have been realeased on bond to hip and have not yet been convicted. my last 2 dui's were in 2009. I have already started my treatment classes and therpy. I also have a letter from my AA sponser about my progress on step work and sobriety date and cps worker about the importance of no jail time due to the return of custody in progress for the next month. the first court date the prosecuter wanted 90 days hip 90 days jail. I was pulled over, I had a open container. The officer asked if I had drink any, me being nice admitted to drinking 2 beers that evening it was now 11:00 pm. I was then placed under arrest I tryed to explain that I was not drinking prior to driving. I also asked to be giving a breatholizer and got told that i could not be giving one. I argued with the officer while getting out of my car. Another officer grabbed me a slung me down on to my face. The officer hand cuffed me as tight as he could drawing blood on my wrist. I recieved 3 big knots to the right side of my head a black and urinated blood for 3 days.
You need to get a good lawyer to first deal with the criminal case and prove it was "unlawful" and had no basis.
