Is it true that if you refuse all DUI tests the courts cant charge you with DUI. By all tests I mean field tests, Breathalyzer at the barracks, and refusal to allow for blood testing. The only proof that the court would have that you had been drinking would be odor. What would you be charged with and is it better or worse.

I failed an ignition interlock test three months ago but waited five minutes and passed. Yesterday, my boyfriend was supposed to pick me up from work in my car and the same thing happened to him.
