A friend of mine received 3 DWI's in Louisiana and just received a fourth DWI in Texas last year. There are 5 years in between the third and the fourth. What can he expect to happen when he goes to trial in Texas?
If convicted your friend could be looking at up to 10 years in prison. Best advice you can give your friend is hire an...
I was arrested for DUI in FL, trial pending. If found guilty, will I loose my driving privileges in other states i.e.- Texas?
I travel for work from state to state, sometimes months at a time. My home state is Maryland
The states have reciprocal license suspensions so if you lose your license to drive in the state in which you have a...
I am an American Citizen that was pulled over for DUI in Germany . Blew a BAC of 1.17 what is the worse case scenario?
I was backing out of the parking lot when I saw two officers walking towards the car to ask me about an incident that happened earlier. I barely backed out 2 feet when I parked it, got out of the car, and they questioned me. They said I passed the field sobriety test but failed the breathalyzer test. They told me I would be getting a call about my BAC blood test after taking my US drivers license. I am only here visiting and have no military affiliation or German drivers license.
This forum only goes to US Attorneys. The DUI laws in Europe are generally even stricter than those in the USA. You...
Is a DWI in TX classified as the same as a DUI in IL? It seems that the DWI is only for under influence of alcohol.
IL: Sec. 11-501. Driving while under the influence of alcohol, other drug or drugs, intoxicating compound or compounds or any combination thereof. TX : Sec. 49.04. DRIVING WHILE INTOXICATED. (a) A person commits an offense if the person is intoxicated while operating a motor vehicle in a public place.
Intoxication in Texas can be from many other substances other than alcohol. The Texas penal code defines "intoxication"...
I am going for 3 months and so far the only response I've gotten was "It's like Kindergarten. You get colored shirts which state your risk level, can't touch anyone or get out of line. There's nap time and rec time and meetings.". I am nowhere near satisfied with that answer. My preferred response has to do with what kind of people I will be dealing with, and if there is a risk (like in jail) of me having to stand my ground which will earn me more time. I do not want to be there longer than I have to, and I think it's complete trash that I have to go in the first place considering I no longer drink and I still attend my AA meetings. This is screwing me out of a job, which will in turn screw my girlfriend on finances. Also, does my time in count toward probation time? Thank you.
I have never heard of SAFPF being a 3-month program. I believe it is usually 6 months with up to a 3-month halfway...
I have two DWI convictions without breath or blood tests. I was taking prescribed Xanax both times.
In Texas, DWI covers alcohol or any other substance, legal or illegal, which impairs you. So your convictions are...
Is there any way to Hire an Attorney to Request a Motion Change or Fight the Drug Court System in Texas?
My Boyfriend was charged with a 3rd DWI/DUI and given 4 yrs of Jail time or option for DRUG Court Program. He started the program and shortly was sent to SATF for a diluted UA result due to drinking to much water. He was sent for 4 months, when released he started the drug court program completing almost 4 yrs if not more with 60 days remaining. The original completion date was Feb 2014 and the Court extended his probation 6 mths as a sanction for a Positive UA. Since then he has been doing all that is asked of him. I am not trying to say he is perfect and has slipped but has been honest with the Court. His sanctions are far more extensive and harsh compared to other individual that are in this program. He does not use Drugs and the Drug user sanctions are far to lenient.
It is unclear what you are asking. If a motion to revoke his probation has been filed, he can hire an attorney to...
