Don't remember much of the incident. But apparently there was property damage to an apt gate. My vehicle was towed and impounded. I was arrested at 5:30am and released at 11am. With a ticket for public intoxication. I'm just confused because if they believe it was me to cause the gate damage in my vehicle. Why would I not be charged with DWI? I don't recall much of the night and the report is not ready at this time. But was told over phone that I failed a FST. No blood/urine/breath test were taken given I was arrested for public intoxication. Any help is greatly appreciated. I don't recall where I was arrested being asleep in my truck or asleep elsewhere.

I have been going to AA, taking the 32 hour DWI Intervention classes, taken a Victim Impact Panel, taken a A/D Evaluation, going to out-patient rehab, seeing a psychologist for alcohol dependency and depression, and have been gainfully employed at the same job for the past 11 years. I was charged with the 2 DWI 8 years ago within a couple months of each other and was convicted of both at the same time. They were both charged as Class B's. In none of these incidents was there any property damage or anyone injured. I have also never been to prison or charged with a felony. I was curious if any of this will have any bearing on my sentencing and also for some reason almost all of my paperwork from the police report to my booking state all of this happened months from the actual occurrence.

2 months in to 1 year probation, foolishly failed a urine test for alcohol/marijuana. NO offenses or problems since then but feel I'm being dealt with harshly because I am gainfully employed and, ostensibly, have ability to pay. Have paid court costs religiously, shown up to all P.O. appts, underwent a VERY CASUAL 10 minute TAIP eval. three months ago because of early failed test and result is now "intensive" 9 week outpatient treatment that will cost me almost $1,000. Have interlock device on vehicle, paying monthly for that privilege, too. They saw me coming. Do I need to suck it up and get a lawyer to handle this or do I have options? I feel that if I were indigent, I would be treated more leniently. Costs related to this are almost rendering me indigent as it is. Advice?
