I got a DUI in Kennewick, WA in 2008, while going through a divorce and planning a move back to my home state of SC. I was to be assessed and take classes in SC. I began the classes several times, but never actually completer them. Now, not only has my license here been suspended, but there is a warrant in WA state for being in violation. This is really a set back for me not being able to have my license. What's the statute of limitation?
Statute(s) of limitations apply to the time in which conduct can be charged criminally. They do not apply to create an...
I now live in South Carolina. I have a warrant in FL for my DUI. Can I take care of it with payments or do I need to go back to Florida. I was on probation but moved to SC.
It sounds like a technical violation for absconding from supervision. You'll need to contact your PO and see if he/she...
Four years ago I got pulled over for a D.U.I. In south Carolina, while I was living in Mississippi. I was later proven innocent in court. Two and a half years later I was in south Carolina again when I got pulled over for turning right on a red light when it was not allowed. The officer then told me my license was suspended because i refused to blow in a breathalyser two and a half years earlier. My question is why was I never informed about this license suspension in court or in writing? My address in Mississippi remained the same for two years. I called the my dmv in mississippi and they had no record of my license being suspended. Now I thought if your license was suspended in one state then it was suspended in the state that you live as well. Was I wrongfully convicted of a D.U.S?
If you refused to blow you should have been given notice that your license was suspended and the police officer should...

I was arrested in Columbia, SC for a first time DUI. I have no criminal record. I provided a breath sample. Can it be expunged?
I blew a .18. I would like to know all of the steps I need to take to get this exponged from my record. I am also supposed to be leaving the country this August to work in China.
Step 1..Hire a DUI Defense lawyer. The lawyer can try to assert any defenses available to your set of facts. If the...
What is the legal BAC limit to be convicted of a DUAC (Driving with Unlawful Alcohol Content) in the state of South Carolina?
I was arrested for a DUI and thereafter plead guilty to a DUAC < 0.08 (less than 0.08) on the plea sheet. At that time I was led to believe that it is illegal to drive a motorized vehicle in the state of South Carolina after consuming any amount of alcoholic beverage.
I am licensed to practice in Az not SC so I can't answer your question, however your question should really be how do...
I was arrested for a DUI about six months ago and my suspension is over. It was not only my first time arrested but my first ticket as well. I was very nervous and refused to provide a breath sample. I was always told if I was ever arrested not to say anything and not to provide any evidence that I did not have to. My case was ultimately dismissed because the officer did not provide the prosecutor with any evidence. I surrendered my license and served the six month suspension. Since I was not convicted of a DUI am I still required to take the ADSAP class?
Yes. The implied consent suspension is separate from the DUI itself. The DUI is a criminal proceeding, but the...
