I received a DWI conviction over three years ago (I was stupid, and I am forever sorry for it.) When applying for a job out of state, I see two questions: Any criminal charges currently going on other than traffic tickets?" Stated "No" since I was not involved in any proceedings at that time. "In the matter of a criminal offense felony or first-degree misdemeanor, have you ever been convicted, pled no contest, been on probie, enrolled in a pretrial diversion program or had adjudication withheld?" Again I answered "No" since in New Jersey, a DWI (N.J.S.A. 39:4-50) is not a criminal offense; it is a traffic offense. A serious one, to be sure, but a traffic offense all the same. What is happening now is that HR is trying to disqualify me for the DWI, even though I was truthful.Any recourse?

To be more specific, I was convicted of DWAI in NY. I got a 20 day stay on my conviction meaning it won't take effect till Dec. 25. My NY public defender says I can avoid the 3-year $1,000 fine from the NJ DMV if I voluntarily surrender my license before it is suspended. Is this true? My other question is, I depend on my car for my job. If I do decide to surrender it, I don't want to end up surrendering it before I have to and miss out on time I could have worked. How long before the NJ DMV finds out about my DWAI conviction and suspends my license? Thanks for the help! - Andrew Thompson
You cannot avoid the $3,000 surcharge. NY is supposed to forward the information to NJ, but often it never gets there....
My court date was set for September 29th but I received a call from my attorney that it was postponed by the judge. I did not receive any mail from them the week after but today I received a notice that I failed to appear in court and that I could have a warrant for my arrest. Why is this when they were the ones that postponed it in the first place?

-multiple charges from one incident: leaving scene of accident, ag.assault (domestic), pos.drug para., d.u.i. -received restraining order vs.other person involved. -was high on marijuana & also blew a .08 so was charged w/pos.drug paraphernalia, d.u.i. -went straight to hospital crisis.unit.bc.he was suicidal upon being arrested. Is also seeing a therapist. -might have a substance abuse prob., but.has.not.been.in.rehab, just counseling and has.a psychiatrist. -works full-time, was once a very good student, has made bad.decisions when.high- stated.this.to.us privately. -extremely worried bc he was charged so severely-ag.assault on his sig.other.

I just got my license and have been using my dad's car to go to my new job. I just checked the sticker and it expired last year!! Is it true that you can get 30 day imprisonment for driving with an expired inspection sticker? I am in a complicated situation as I just started my job and I can't just show up late or not show up for a day.
Just get it inspected ASAP.
