I went to court for a DUI charge, it was a two day trial. The police officer was using my blood work from an illegal search warrant (he hadn't taken the appropriate steps to obtain blood work from the hospital). So the judge threw my case out. I spent 6,000 on my lawyer and now I'm scared that we're going to have to start all over again, because the crown 'appealed' my case as soon as it was thrown out. The crown is trying to find a loop whole in this big giant textbook of court rules, and now there's going to be a 'trial within a trial'. It feels so wrong that I should have to pay for a small glitch in the system, will I be able to sue the crown after this is all over? Any advice? Thanks.

I have just been informed that i need to serve 10 days for DUI but I am leaving town in 8 to attend a school out of state, thus not giving me time to serve. I have worked to hard and invested to much for this opportunity to not take it. Is there a way to take of this when I get to where I'm going??? Please help!!!!
Judges don't appreciate it when defendants decide their other obligations are more important than the court's orders....
She ran me over while she was drunk but they let her go. NOw they are trying to charge me with contributing to a minor and obstruction. She was charged with an MIP, the judge later dismissed it if she moved away. THat leaves me here with a broken leg and wondering why I am getting the brunt of this. I tried to stop her from driving drunk when she ran me down.

I understand that Montana has a 5 year lookback period for DUI which is less than the 10 year lookback in Oregon. Given that I will be completing ACT program here in Montana will this be considered a repeat offense for ACT thus requiring treatment referral? I was convicted of DUI in Oregon 8 years ago and again in Oregon this past year. Thank you in advance for sage words of wisdom regarding completing ACT here in Montana and specifically if I will be treated as a repeat or first time offender in the program.
