If the officer is in his car with the door shuts and I am in my car with the doors shut is this considered sufficient observation? How could be know that I did not burp or have any regurgitation? Is he also required by PA law to administer two consecutive breath test?
An expert can review it and determine whether there are issues with how the test was performed. Typically, the issues...
Has anyone successfully argued invalid breathalyzer resuts for readings above .15 based on the Dauphin County ruling that anything above is not reliable because the machines are not calibrated for all possible ranges?
yes.
The first DUI he recieved when he was 17, he is now 29 so it has been over 10 years. I'd really like to get this one off his record because he was a juvenile and I thought that your Juvenile record doesn't get to be taken into consideration when you're charged as an adult? He got his 2nd at 23 and his 3rd at 26. We were told by his lawyer that once 10 years had passed he could indeed look into getting one expunged? They were all in PA and I'm confused because looking on here it seems that isn't the case; which leaves me wondering why his lawyer said it was possible for the right amount of $. He's not yet 30 and I hate to think of him stuck with these 3 strikes forever, no matter how much time goes by. Also, it looks bad for future employment opportunities.
There are only a few ways to have something expunged in PA. Obviously if your husband was placed on ARD for one of the...
My Fiance was sentenced to a 12-24 month state sentence for a 3rd DUI. He was also sentenced to a consecutive 90 days for a driving under suspended license charge. When sentenced, his Probation Officer decided to charge him with his back time of 22 months running concurrent with the new DUI/Suspended License charge. We were told by his lawyer that he would be eligible to see the parole upon completion of the mandatory DUI sentence (after 15 months) but it turns out he will not see the parole board until the whole 22 months is served. He has been in for about 7 months now. Is there any action that we can take to ensure that he will see the parole board upon completion of the mandatory 15 months? Is a sentence reconsideration still at all possible or is it too late? Thanks for your Help!
Do not rely on Avvo brief answers, speak with a knowledgeable competent criminal defense attorney in the area without...
I was stopped at a sobriety check point, was taken to do the field tests as well as a Breath test (which I was told I did not have the right to refuse or I would be charged with the HIGHEST legal limit) I had to take the breath tests 4 times, reason unknown to me. After taking the last Breath test (results were .117 )I was told I was being charged with the suspicion of DUI. The officer handed me my cell phone and asked me to call someone to pick me up and my vehicle. My ride arrived and I went home. The next morning I was given a call by the officer stating that I needed to go to the station for fingerprinting and processing. I had asked the officer why that wasn't done that same day and he replied that it didn't need to be done that same night.
I would not say that this leaves you in the clear. You can recieve a citation after the event. It may allow more...
My car was parked with nobody inside when it got hit. The driver was drunk. My car was totaled, I did not have insurance on the car at the time but I did receive compensation from the guy's insurance company. I received restitution letter from the county DA and would like to know how to prove my economic loss and what I can receive as compensation.
I would guess that you would get what the car was wort, which would probably be something like its Blue Book value. Basil
I was approved by the DA for ARD. I got my Approval notice in the mail, but the next day i recieved a notice of a pending criminal trial a month from now. Did i get denied already or is that just scheduled for if i get denied at the ARD hearing?
My guess is that the righthand doesn't know what the lefthand is doing. Check with your attorney. If you do not have...
