I was arrested for a DUI in Alameda County , California . I was driving over the speed limit with a . 09 bac . This is my first offense , I have a clean driving and criminal record , I was respectful to the arresting officers , I am a high school teacher . This is already going to cost me an arm and a leg . I cringe at the 1 - 2K that an attorney will cost me , especially if it is fairly standard to give first time low BAC offenders a wet reckless anyway . My question : is it possible or advisable to ask the DA at the arraignment whether a Wet Reckless deal is possible before I retain an attorney ? I am at peace with the fact that I am not going to get the charges dismissed , but I am also a good defendant and have no past record of bad behavior so I do feel somewhat deserving of a reduction .
It depends how well you can negotiate your case and what the facts of the case are.
I received a DUI citation on December 7, 2012. It is now May and I have not gone to court yet. My court date is set for July 24, 2013. I did have my DMV hearing on February 4, 2013. According to the results of the DMV hearing I can get my license back on June 24, 2013 if I have not yet been charged by the courts. So my question is, if I start taking a DUI class, and then apply for my license in June will the courts re revoke my license ? Or will I be able to keep it?

I pleaded nolo contende to a a first offender DUI case in contra costa county CA in 12/2010 and was given community service and 9 months of DUI school. I have completed the community service and 3 months worth of the DUI school, but had to take and extended leave of absence and was terminated from the program. A few years ago, I was 21 & in medical school when I was cited for possessing an open container in public while walking in Berkeley, CA. (B&P 25620, which I believe is an infraction.) I pled not guilty in court and the officer never showed up to my follow up court date and I did not pay any fine and the charges were dismissed (I think). I will soon be applying for my medical license in CA and the application FAQ(http://www.medbd.ca.gov/applicant/application_faq.pdf) states I must disclose all convictions as well as all cases in which I pled not guilty or no contest, even those expunged by section 1203.4 of the penal code. This includes infractions. The Board receives information regarding actions that have been dismissed or expunged. I was not convicted so no need to report this? Thanks!
