My 19 year old son was at a fraternity party he was intoxicated. He left the party as he was walking he stumbled and fell. A police came to assist and noticed that he was intoxicated. He asked for my son's license which was given to him. The officer then took my son's wallet and look through it an found a fake ID. He issued tickets for underage drinking and fraudlent misuse of a license not issued to him. My son's license has been suspended for a year and seven months. We are trying to get hi license reinstated and I must find grounds to show that his license should be reinstated.

If your son let him do it, it's probably legal. You should fight the ticket.

When the judge is considering sentencing for multiple DUI does he/she count just convictions or both conviction and supervision. EX: 1 supervision DUI (24years ago) and 1 DUI conviction (11 years ago) and now 1 arrest ....will it be sentenced as 2 DUI or 3 DUI... only asking about court NOT DMV.

This will count as DUI #3 for sentencing purposes.

Convicted of a DUI in 1978 and has gone through the counseling required. Counselor did not complete necessary papers correctly and husband has still not been granted a hearing. Plus no record of the arrest can be found in Springfield.

I'm on an RDP, level II Sig Risk. I've had the BAIID device since June 2012. No violations and no letters from the SOS. Last Saturday, my mother tried to move my car, after using mouth wash, and blew a .025. Not being familiar with the device and not wanting to mess with it, she did not try starting it again and just left it alone. I have my SOS hearing for full reinstatement on May 13 and I'm not due to send the BAIID in for inspection until june 17. Will this incident cause SOS to deny reinstatement for me? Also, since they won't have record of the .025 reading until June 17, almost a month after my hearing, will it even be an issue? Thanks!

I just had my first DUI a couple days ago, I have court coming up in a few weeks, I was asked to blow the breathalyzer, but refused to, I was kept in a cell for the night . My car was impounded being charged $2000 to take it out plus storage fees, I was wondering if I can take out by payments or something like that. I was algo give a couple moving violation tickets. Is there anyway to get the tape from when this happened. He had me walk over to a machine and when I asked him to explain whats required for this test. What is this machine. It then said that 3 minutes were up and that was it. After we sat back down I asked repeatedly, now that I understand the test I would like to prove my innocence. He refused multiple times and made comments about all the "paperwork" that he was doing. Where can I go from here. He also said that I failed one of the FST's because I touched the bridge of my nose instead of the tip. It was never stated where on the nose. 4 years ago I had a DUI and it was dropped to probation NO conviction because I was a min risk. Since then the only thing I have had is a small speeding ticket. I now have this OWI in IN that has been dropped to reckless driving and I am on probation for it. I have not had my license suspended yet in IL. Will I be? How long will it be for?
