My daughter was charged with underage drinking reading was .023 could taking nyquil or halls cough drops affect the reading?
My daughter was sick over the weekend and had been taking nyquil and halls cough drops. She had a campfire and some people showed up who were not invited. The cops came and a lot of those poeple fled. The cops tested the other ones and my daughter tested .023. She told me and the cops that she wasn't drinking. She was even eating a halls cough drop and had to remove it to take the portable breathalyzer test. I asked the police to take her for a bloodtest but they said it was my responsibility to do that. I took her to the hospital as soon as I could and we then had to wait about another hour in the emergency room before they did the blood test. The test came back with no trace of alcohol. I also had them do a urine test to test for drugs which was also negative.
You should retain a criminal defense attorney to represent your daughter. The key is to attempt to avoid a conviction...
Charged with a first offense DUI
I recently was charged with a first offense DUI w/ a hospital blood of 0.11 and weaving. I had appointments with two local criminal attorneys and both stated that the only thing to due for a DUI is plead guilty and enroll into ARD or IPP, because a DUI with hospital blood tests are impossible to win, plus the local DA’s or the local Judge that presides over the DUI court will not withdraw or dismiss a DUI case because they know more about DUI case law then anyone else. I would know to know if anyone knows of someone that is a good DUI trial attorney, because given the circumstances of my arrest I would like to fight these charges if possible.

I had my 1st dui 3 1/2yrs ago, which was expunged with ARD. I just got another dui, will this count as my 2nd offense or 1st?
I received my papers for my preliminary hearing, and they state that I am being charged on 1st offense. So this is where I am confused. Everyones telling me the judge will change the charge to 2nd offense
Well it should be charged as your second offense. If the DA realizes that you were previously on ARD they will probably...
First dui...what can I do
I just got my first DUI. I blew a .14. The cop never told me why he pulled over. I asked him at the hospital while getting my bloodwork & he said I was swerving (he told my fiancee that I was speeding & swerving). I didn't get any kind of traffic ticket tho. I'm worried about my bloodwork because I quickly finished my last drink because I realized how late it was and wanted to get home. Could my BAL have been higher at the hospital? Can they say I was also driving under the influence of pot even tho I hadn't smoked that day? I'm a stay at home mom...I go out once a month if that. I've never been arrested and never had any ticket or accident. Is there anything I can do to reduce my charges or keep my license? Is it worth getting a lawyer or just plead guilty?
A dui case is a criminal case, and has potentially serious consequences. You should be motivated to do everything you...
