He was the only one involved. No injury or damage to anyone or thing other than himself and his vehicle. He is 16 years old and alcohol level was .283 which I know is extremely high. He has never ever been involved in any bad behavior, he is a great student and athlete. I need to know what my options are to protect his future as I know this is a very serious offence. We live in the state of Washington which is where the accidient happened but he also lives part time with his father in Oregon which is where he and the vehicle were liseanced. Please help....
It is important to contact an attorney immediately to discuss your case. Without the facts of the case it is hard to...
I was pulled over for drunk driving the other night and I blew a .088. The cop wrote on my ticket thing that the charge was for minor operating a vehicle after alcohol consumption. When he asked if i had been drinking I was honest and told him yes. I was really respectful to the cop and didnt fight anything. What could be the penalties? I looked it up but I couldnt find anything stating the consequences for a person charged with a DUI who is under the age of 18. Also, this is my first time ever dealing with police, so I have no previous record.
I don't practice in Washington, but more than likely you will get a summons to appear in juvenile court. In theory they...
I got a Minor DUI about a month ago, and I'm trying to get it reduced to an MIP and also get a diversion. This is the first time I have ever gotten in trouble with the law. The prosecuting attorney offered to reduce it to negligent driving, and 5 days work crew with some fines. The thing is, negligent driving stays on my record and I'm only 17 so I can't do work crew, so I would have to go to jail for at least one day, which I'm trying to avoid. I cannot afford a lawyer but I don't qualify for a court appointed one. I did have a consult with a lawyer though, but I still have some questions. Since I am trying to plea the charges down myself, how would I go about trying to do this? More specifically, what kind of things could I present to the prosecuting attorney or the judge, to prove that I'm a good kid and that I'm not going to do this again, that could help me plea it down?
If there are no proof problems in the case, a Neg2 is not a bad deal. You can do a DUI victim's panel and/or do a CD...
Car wreck, rollover, rushed to hospital for emergency surgery. Can they say I agreed to or consented to the test while in and out of consciousness?
If you were taken to a hospital where there is no breath testing device, then the police would need a search warrant...
I was pulled over for a DUI a couple weeks ago in WA state and I'm currently still going through the legal process, however, I am currently on supervised release and I was ordered by the judge to take either antabuse or a ankle bracelet that monitors alcohol intake. Real question is, does this violate the constitution in some form since I am currently not convicted? Innocent until proven guilty? or am I missing a bigger picture?
Does this violate the constitution? Probably not. Innocent until proven guilty... in theory only. Good luck.
I have been charged with DUI in CO, and my CO DL has been revoked pending the outcome (I could also get interlock in CO now). Due to current loss of driving privileges, I lost my job. Want to move back to WA for new job. My WA DL expired 01/14. What needs to take place in order for me to be able to drive in WA asap? Would filling out an Out of State Residency affidavit lift the hold on my CO DL, and allow me to renew my WA DL?
You need to speak with a WA attorney who specializes in license renewals and also has knowledge of DWI matters. The out...
If looking at possible 5th DUI and one was reduced to Neg 1, how long will that be on the driving record and why would DA or defense attorney keep referring to it as a DUI in the first place?
A Neg 1 reduced from a DUI will count as a prior DUI for 7 years, just as if it were a full fledged DUI. If all 5 of...
