I was driving down the street and a possum ran in the road, I swerved and ran into a pole. i left the scene and went to a bar. a short time later i was arrested and charged with multiple driving infractions the most severe being dui because i could not pass a field sobriety test. i also refused a Breathalyzer. if convicted, this will be my third dui and can result in 10 years loss of license, $10,00.00 fine and 6 months county jail. how can i be convicted of dui if i was not at the scene. how can it be proven that i did not get drunk after i left the scene?

When I go to the NJ MVC hearing unit, would it be a good idea to bring information with me pertaining to my argument or is the original hearing request letter I sent and my driving record all I'm going to need? I was also wondering if the reduction STRICTLY applies to proposed suspensions that aren't in effect yet. If im already serving a suspension is a reduction in the TOTAL suspension(suspension being served and suspensions not yet in effect) out of the question or is it the MVC representatives decision.
