i have a warrant for the dui for missing my court date and the matter is about 18 months old at this point. I am nervous because it was the secound time i was charged with dui before the age of 21, but my first was down-graded to reckless driving. My issue is i need to be able to take care of it on a trip home and be able to settle the matter and not have to deal with jail time, and the community service, and classes. I do not know if that is possible so thats why i am reaching out. And, is it possible to pay off all fines and surcharges up to date to get like a time-served style suspension since my license has been suspended this whole time anyway so that i could come home to florida and get a license here.
You should retain a lawyer. The lawyer will evaluate the case and conduct discovery. If the best option is to accept...
I got a DUI for there being drugs in my system even though my BAC was .06. This occurred while I was on probation; as such, I have since passed several drug tests. Additionally, I recently took a DSM 5 Point Diagnostic that also involved a drug test that determined I do not require further treatment. My fear is that because on my scantron, I answered honestly saying that I had attended NA meetings, I will be further referred. I told the instructor straight up that it was back in high school (now 23) and my test will confirm that though I admitted to hard drug use, I haven't in over a year. My biggest concern is that I will be referred by default, fail for marijuana as a result, and be screwed. Any insight would be helpful.
That is up to the IDRC counsellors.
My fiance was charged with a DUI blew a 0.08 but the Alco test ended up being thrown out we stayed in court until 1:30AM and he was still charged 9 months loss license the lawyer asked for a stay in the case for an appeal the judge granted it. - Well the township STILL put the charges through even though they werent supposed to, the lawyer contact the twp sent them a letter and us a letter stating for thee stay in the case but the twp still has the charges 3 months later. we have a court date to appeal mid- sept. SO my question is do we have a good chance of getting this dropped because of the twps multiple clerical errors? ALSO, if they keep the charges since he already served 3 months with no license will they grant that as time served
What did your attorney say when you asked them? As for getting the charges dropped, that would depend on the original...
I had a BAL of .126
Both PA and NJ are part of the interstate drivers license compact so you would probably be suspended here as well....
How long can you be sentence to probation for a 4th degree felony (crime)? (Question for REAL ATTORNEYS; NO MUNICIPAL LAWYERS)
I was sentence 5 years on a 4th degree to probation (suspended incarnation). It was dropped from a 1st degree felony (crime) to a 4th degree felony (crime). I have my discovery & all documents for my case at hand. My understanding is the maximum you can be in custody for is 18 months (incarcerated) for a 4th. I am looking to apply for PCR in SUPERIOR COURT! ; Not Municipal Court; REAL ATTORNEYS' PLEASE RESPOND PLEASE & THANK (RSVP) * I already completed 2 years on probation and my lawyer didn't make me aware of PTI (since it was my first arrest ever I could have applied) PTI Motion was never filed. Is this an excessive sentence and PCR eligible?

I had one dui in 1984 and one refusal to take a breath test in 1986. Then i got a dui in january 2010 and in february 2010
i got a refusal to take a breath test. i received a 10 year loss of driving(all occurred in new jersey). Am i elgible because of the old convictions some type of relief so i can drive sooner than the 10 year revocation?
You should have received the 10 year step down between DWI 2 and 3. However, that does not apply to DWI #4, which is...
What happens to a 3rd DWI offense if you re-open the 2nd DWI case knowing you can win and the 1st one was 13 years old?
My 1st DWI was in 1999, my 2nd was in June of 2009, my 3rd was in December of 2009. I already did 6 months in jail for the 3rd so everyhing is done with all of them. I am going to try and re-open the 2nd for the 20 minute observation. I know I can win but the lawyer I had at the time did not try to fight it. The officer that did the breath test came in the room 3 mins. after the arresting officer left only to give the test. He was there maybe 10 mins. The times are in the Discovery. So what would happen if I won? Thank You
In Wisconsin, the current third would count as a second offense. However, I wouldn't hold my breath getting the...
