His probation officer said he wasnt going to violate him but it was up to the judge if got jail time or community service...he has a couple driving with a suspendd lincense..my question is will he get jail time?
Possibly. He should hire an attorney to represent him. An attorney will minimize the chance that he faces jail.
Had an interlocking device on my vehicle and the vehicle was stolen from me. A week later I was in jail for violation of probation being a few miles out of jurisdiction. I've been out for 2 1/2 months, no DUI's for a year and no failings of interlocking device. My license was revoked by the time I got out due to failure from the device company. I related to them that my car was stolen, police report sent to them and to the DMV and the device company will not send a letter to DMV of error of failure to device to the DMV per the DMV request. Everytime I call to get it straightened out, everyone gives me a different answer. The device company said I should have notified them that car was stolen while in jail but you don't have free access to phone calls, they wouldn't receive collect

I was arrested for a DUI. It was a fair cop - I had been drinking, and I'm not contending there's any way around that fact. However, the officer that stopped me had been in someone's driveway at the time, and I later found out they had no permission to be there, which, LEO or not, is trespassing. At the time of my arrest I was told he had pulled me over for doing a rolling stop at a stop sign, which I had done. Later when my lawyer was going over the report, the officer stated that I had nearly hit a parked car and had run up on the curb, both of which were not true. I couldn't prove the report was untrue, but should I have fought harder against the DUI charge given that the officer clearly wasn't too fussed about following the law himself?

How do I go about having a misdemeanor DUI judgment vacated/expunged? I fulfilled all requirements and am no longer on probation. There was no accident or other party involved. I have no other incidents on my record. It occurred in 2005 in Auburn, CA while I was going through a divorce. I work in education and volunteer with youth now, and would like to put this behind me for good. :)
You need to file or have an attorney file a 1203.4 petition. Be aware, however that this petition if granted does not...
