When I received my DUI I blew a .10 and I served 3 weeks in jail. What usually happens in Court? I do not live in Asheville, NC where I was arrested I live in another state. Is it possible to have the charge expunged, if so what do I need to do?
It depends on many factors. Was there an accident with serious injury? Was a child in the vehicle? Need more information.

I have completed all my requirements for NC, and I am eligible to get my drivers license. I was resident of NC at the time of arrest, but I had not taken the NC drivers license test yet. I was driving with a Florida drivers license. Florida reports that my license are revoked now. They counted this DUI with the previous DUI's in Florida that I got when I was young. I fell asleep while pulled over on the Blue Ridge Parkway in NC after nearly two days with no sleep. It took officers a long time to wake me up and i was obviously dazed and confused, i failed all 3 FSTs (walk and turn, 1 leg stand, HGN) but blew a 0.0 and had blood taken that i know will come back negative for any illegal substances, however, they also found synthetic marijuana that i am assuming will be deemed non-controlled and wont be present in my blood. Also, my girlfriend was with me and was obviously not intoxicated but had also been asleep. I was charged with dui-d which is a federal charge since i was in a national park. Im being told i can still be convicted based on the officer testimony even if the blood test comes back negative. Is this true? I would appreciate any advice.
