In 2003, I wrecked my car whilst under the influence of alcohol. Though my car was definitely totalled, I was unhurt, and when the cops arrived I told them not to call for an ambulance because a) I was not injured, and b) I did not wish to pay the enormous amount of money a hospital visit costs. Despite my protests, I was more or less forced into an ambulance. Was this a violation of my rights?
Nine years later and you are just getting around to asking about it?
Ex-husband going to County court soon on citations. He already has a suspension of his license for DWI from another state along with an arrest warrant. He blew .05 but with a blood draw he received a DWI. He is on Rx Methadone and other painkillers as well. My 2 small children were in the car with him. I am seeking knowledge on this so I can prepare myself to be able to deal with my children. Any help would be greatly appreciated.
If your ex-husband has one prior alcohol related driving offense, the case should remain a misdemeanor, if he has two...

In 2010, I received 2 DWI's. I was 20 years old. Between then and June of 2012, I went thru an outpatient rehab, 100+ hours community service, changed jobs and got back in school. My attorney suggested this may help the court have mercy on me. The offer I received from the prosecutor required me to plead guilty to both DWI's, spend 48 hours in jail and my license is suspended for 5 years, with possibility of a hardship after 2. I have 1 year time served. I moved in with friends, so I would not be driving anymore. While moving I did drive and was in a car wreck in my roommate's truck. Yes, it was my fault. I have a ticket for driving while suspended now and am wondering what the possible consequences will be and what I can/should say to the judge to explain myself.
In Missouri, first violation of for Driving While Suspended/Revoked shall be punishable by a fine not to exceed three...
My friend hit a parked car last night and, being inebriated, stupidly left the scene of the accident. He was subsequently pulled over as the police had seen him hit the car. His blood alcohol level was .19 upon testing, and he is currently charged with a DWI and leaving the scene of an accident, both as misdemeanors. This is his first DWI, and in fact his first time being charged with anything. Exactly how much trouble is he in, and would this be a case where diversion might be a good thing to try? Any information is helpful, thank you in advance.
Your friend is in quite a bit of trouble, especially if he does not contact an attorney within 15 days of his arrest....
He asked me for the name and the age, but I didnt get a breathalizer or anything. In the ticket it just appears my name and the violation, an MIP. What should I do know? Should I expect a letter letting me know the court date? Is there a chance that I will not get anything and just go away with it? Thanks
He probably got you for being visibly intoxicated. Or if you were holding a drink, that would be enough right there....
I was pulled over for supposedly not fully stopping at the red light. This is completely false. I was coming back from a friends birthday at the bar. I had 2 beers and 1 drink. After, I took time to sober up for 1hr15mins. The cop had me do all the field sobriety tests. I refused the breathalizer. I passed all the field sobriety tests with ease. He had no choice but to arrest me for refusing. I dont even want to deal with a DUI right now, financially and mentally. Its stressing me out. I didnt blow because I didnt want to risk anything incase I blew a little over or under. How will the prosecutor go around making a case out of this?
The police report is going to reads a whole lot differently than your recollection of events. He is going to say you...
