I was convicted of my first DUI two years ago in which I blew the minimum limit .097. I attended the 6 week drug and alcohol class a year ago. I did not have the interlock system installed in my car. Is this the reason for which I am being summoned? Because I was under the impression that I did not have to have the interlock given the circumstances of the situation.
Minimum limit in all 50 states is .08
I got charged with first offense DUI September 2011. The judge did not accept a plea upon me voluntarily entering the interlock program. In March of 2012, i was caught driving with expired registration and charged with my second DUI because of my revoked status. DMV sent me no notification of my license being suspended or my registration needed renewed. The court of the Second DUI now has jurisdiction over everything, but they have yet to set a date for me to appear. After march, can i request for the case to be dismissed, take my classes, pay my fines and get the charges dropped and my license back?
While I don't practice in WV, I find it difficult to comprehend how you could be charged with a second DUI due to your "...
Was arrested for DUI in May of 2010. The criminal case was dismissed for lack of evidence and the officer never showed. My first dmv hearing was in dec. of 2010. In which the officer didn't show. The second scheduled hearing was scheduled in the spring of 2011 and continued to another date. Finally had the second hearing a year later in the spring of 2012. That summer I got a DUI in Ohio. Once they turned it into the DMV in January of 2013, then they issued a year long suspension starting in march. The DMV is saying this is my second even though there was no decision on the first. With no sign of a third hearing in sight to fight the first alleged DUI arrest. Help.
The only advice I can give you is to hire an attorney. Good luck.

Basically i left the bar after drinking and i hit a parked car then a telephone pole. Another driver saw me hit the pole called 911. Police show up and give me a breathalyzer which i failed but passed all the other tests, such as I knew where i was, what the date was and the finger to the nose with your eyes closed.. There was a vehicle that hit the parked car i hit because it was in the street. The lady in the car was fine and actually a friend of my moms. I was the only one to go to the hospital, took blood and patched me up. I then left the hospital. I was never arrested or given a ticket or citation. This is my first time ever being in trouble and the police report said a subpoena will be issued at a later date after my blood work comes back. I found out the charges thru insurance comp

He was driving on the interstate and was in a single vehicle accident only injuring himself and getting a DUI. His court court case has been cancelled and rescheduled 3 times since then. This last time for the arresting officer going to be on vacation. he now has to wait til 8/2013. Is there away his case can be dropped due to them continuing to cancel the dates?
Only IF there is the passage of 365 days of uninterrupted scheduling of a hearing would that be legally doable. Any...
Family member of Hispanic origin, cited for DUI - true enough, however, when in custody in the police cruiser, the officers areon recorded videocam making guesse about his ethniciy, "mahaji ?, (not sure of the term but refers to midestern radicals, a couple of other ethnicities almost in a joking manner of speaking, until one officer says, well he sure ain't caucasian! I have heard of other case being thrown out due to "racial profiling". And in the next 30 seconds they are discussing what all they could charge him with. Does this fit racial profiling? And is there laws in WV against that? How would you suggest handling this specific
