I work in bars as a DJ and a Karaoke host. Is there anyway I can still do this? My probation officer says no. But this is my JOB! I'm supposed to quit my job and still pay my fines? I have no problem with not drinking while Im there, but I still need my job. Any suggestions?
At least at this point, your boss is your PO; if he/she will not permit it under the circumstances then you must comply...
I was arrested for DUI First Offense, BAC 0.146, no accident or injury and preparing for my court date. I have a relatively clean criminal history which includes shoplifting, MIP of Tobacco, and simple assault as a minor (a few bad decisions and a school yard scuff on my part) and a speeding ticket as an adult. I do not believe my juvenile records are sealed. With my history, would I qualify for a deferment?
Deferrals on DUIs are rare. Consult in person with a local defense attorney.
Illegal stop?? I was stopped for now front plate in Iowa which resulted in DUI. Car is registered in Florida where no front plates are even offered. It is a very small town and the police know everybody...I have driven past every cop in the county and they have not stopped me before. I feel as though I was "harrassed" in a way. I was also never offered a blood test vs. a breath test and was never read my rights. I made sure to ask if I had swerved or was speeding to which the officer answered "no, you were stopped only because of no front plate". I was also never told I was being arrested however was detained in the back of the car from the very beginning of the stop.
You may very well have a motion to suppress. Need to retain counsel.
My niece is 19 and was recently at a college party where she admits to having 1 drink with friends. After the party she and 2 of her freinds left to go home when she hit a deer, there was extensive damage to her car and the deer was laying in the roadway. She called the police to report the incident and when the officer showed up things went very wrong. The responding officers stated that since they could smell alchohal the made her perform field sobriety tests and a breathalizer, while she only marginally passed the field tests she blew a .000 on the breathalizer. At that point she was transported to the police station, provided a urine sample, and then read her miranda rights and arrested under suspicion of DUI. The results of the urine will be negative yet the county is proceeding.
You have not asked a question, but yes, she needs a lawyer. She has defenses.

2nd offense OWI in IA in 2008, lost licence 4 years ago, due to get it back next month. Have paid all fines and complied with all court agreements. DOT is now stating there has to be a breathalizer installed in the vehicle in order to get the license back. Issue is this; have recived a promotion to a managerial position with the well known national insurance agency I work at for over 3 yrs. Position requires travel and rental cars, impossible if breathalizer is required. Can DOT impose such a requirement if it was not part of the court decision? If so is there a way to avoid this if able to prove good character by example of current employment status, etc?

I was moved from minimum probation to a new officer and now have monthly visits immediately. I work everyday and really don't drink much at all. What is the best and worst case scenarios here? I am assuming that I am not the first that this has happened to, so there must be a "standard" that the judge follows in these types of cases. Will there be jail time? The probation officerfiled a contempt of court and recommended appropriate jail time and to stay on probation. Is this considered a serious violation? What is appropriate jail time mean?
I don't practice in Iowa but I can tell you that drinking, at all, is a probation violation and most jurisdictions. If...
