Currently in NM and have dwi pending. I refused breath test. First offense. Drive a company car for work and will not allow interlock device. When arrested had CO DL and after arrest got NM DL. I am trying to move out of state and want to obviously avoid interlock device to keep my job. Was thinking about getting a license in georgia due to non compact state. Do you think if I was pulled over in any state with Georgial DL would the officer be able to see this information and would most officers arrest me? Does this sound like a way to avoid the interlock? Any other advice is greatly appreciated!
No one is going to really advise you on how to avoid an interlock when there clearly is a reason for the device to be...
Violation of implied consent act, how does the IID requirement work when dealing with 2 separate cases with a time lapse in NM?
So I have had the administrative hearing and was found guilty, but have appealed it and waiting to hear back from judge(I will be found guilty at some point). I did this to extend my driving priveledges. I have criminal trial soon. If I lose trial and appeal it, which can take 1.5 years to appeal, will my one year IID req. for the administration portion fulfill the criminal IID requirements, and after I reinstate my license will I be good to go or would I have to be worried about a second hold on my license after the appeal comes back on the criminal side? I am planning on moving out of state before getting convicted on administrative side. Your help is greatly appreciated!
Many states share convictions on drivers licenses. Stay and take care of everything!!!
If you go to trial for a DUI and are found guilty, do judges tend to sentence the defendant with harsher penalties?
If you go to trial for a DUI and are found guilty, do judges tend to sentence the defendant with harsher penalties than if you plead no contest or guilty? Just curious about experience that clients and lawyers have had. Thanks for your responses.
Generally this is not held against you and in theory it should never be used against you when you exercise your trial...
Can I get an occupational drivers license in Texas or any other state? I violated implied consent law in NM.
Violated implied consent law at dwi checkpoint in NM. Criminal trial pending and administrative side is being appealed. I am a sales rep and my company will not allow me to drive with the interlock device installed in the company car. Would I be eligible for the occupational license in Texas(if eligible)? Do you have any general advice for my situation? I need representation in Texas, as I plan on relocating there in order to stay employed and will need help getting an occupational license. Do I have to show proof of an sr-22 if driving a company vehicle? Also would I have to sit out the 180 days before being eligible?
Many of us who practice criminal defense and represent people on the revocation of their driving privileges offer free...
Will this be of any help at all in my pending DUI? Can a lawyer use this to get case dismissed?

Violated implied consent act in NM. Will be required to have IID in NM. If I move to Texas before administrative revocation kicks in, would I be eligible for hardship license in TX being able to drive to and from work without device(company will not allow me to have device in company vehicle).
Be careful about how you go about doing things when you move from NM to TX. Sometimes if you do things in the wrong...
I was arrested for DWI. My miranda rights were not read. I was ROR'd. Should I expect a bond at the arraignment? First offense.
It was my wife's car, and I am not on the registration. Could her car be seized? We have it being fixed and have an insurance claim in. It's a high deductible, so I won't have much money to retain a lawyer before arraignment. Will I be more likely to walk away at arraignment with a lawyer. I have a job with a high value to public interest and have never had problems with the law.
If they released you on your own recognizance, then it's highly unlikely that you'll go back to jail at your first...
