My first violation was three years ago.iv completed 7 years of my ten years of probation. Just wanna know if I'm looking at a long time in jail? Any help would be great
The amount of any jail associated with a probation violation is up to the Judge hearing the matter. With this being...

You should seek counsel for this issue. Your facts are complicated and somewhat incomplete. In 1997, VA law required...
I am a Massachusetts resident, and received a DUI in Virginia. I was ordered to 5 days in prison (in VA), ASAP, fines, and to install an Ignition Interlock Device for 6 months in my vehicle. I've done the prison time, paid the fines, and am starting ASAP. However, I do not own a vehicle, and never drive. I live in Boston and take public transportation everywhere. The DUI was on a rental car. My ASAP officer told the Virginia ASAP office this, and they said I had to do it anyways, even if it's a friend's car (which I'll never drive). This seems outrageous, especially considering Massachusetts doesn't make first time offenders install a IID. What can happen if I don't comply with this provision?
Your privilege to drive in Virginia will never be restored. Did you request restricted privileges? If not, you can...
I was pulled over on the highway for "failure to maintain single lane". Did the FST and PBT. Officer said I did fine on the cognitive portion (abcs backwards, date/time etc) of FST but didn't pass the dexterity portion (did twelve steps instead of nine). Blew a .11 on the PBT. I got to the station for the official breath test and got a "deficient sample" reading. I conducted the breath test FOUR times, and complied with the officers instructions. Subsequently, I was charged with Refusal of Test as well
DUI/DWI's are very fact specific and are very complex. So, don't use this board to discuss the facts, instead use Avvo...
the officer said i blew a 0.27 i wasnt that drunk i had two drinks about 30 min before i was pulled over and i never took another breath test at 0.27 i would think i would be passed out
You are right. You would not blow a .27 with 2 drinks. Your lawyer should inspect the maintenance logs for the...
I failed an interlock test once during my 6 month restricted license and interlock period. I did not retest until that evening because I had to get to work with a neighbor. I realize I should have retested and would have probably passed very quickly. I have a camera installed too. I have no other violations and in 2 weeks was set to regain my full license. I notified my PO right away and even took a day off work to speak with him personally before the Interlock service was downloaded. I thought because I was at the end of my probation period my probation and if I was honest, my counselor would give me a break but he went really hard on me and I shouldn't have admitted to drinking the night before for my Birthday. I have not drank any alcohol this year except on my Birthday. Any Advice?
Talk to the lawyer you had on the conviction. You could get all your suspended time and will almost certainly not get...
Was arrested for suspicion of DUI. At the station I agreed to take the Breathalyzer and complied with the officers instructions. I took the test four times, each time with the result of a deficient sample. The officer admitted that I was being extremely cooperative, complying with his instructions and he did not know why I keep getting a deficient sample. He also annotated the police report to show that I took the test four times.
If he thought you were being cooperative and providing the sample as required how come he charged you with refusal?...
