Re: Former jail nurse accused of fondling inmates acquitted
Thanks for the support from the few that presumed my innocence. Wow, I haven't seen much of that & I am innocent! I am hard working, I was up late the night before with my newborn, I was deceived by investigators, I thought I could trust as I was employed for them, to waive my attorney rights during benign questions that led into hours of interrogation, after already working 12.5 hours. I DID have a female present during EKG in question (inmate agreed)& with any female inmate. Jail officials were unwilling to bring forth the females working that day. I could not remember exactly who it was. It had occurred nearly 2 years prior. I am certain it was one of only a few, but the state would not provide names of female staff working that day. The other inmates themselves (all 3) reported that there were female staff members present at least sometime during their visit to the exam room I was using. Their claims all took place in a busy medical unit, during full-staffed daytime hours, with many other Correctional officers, medical staff, and other inmates. Nothing occurred in a locked, shady, private member's only room, the rooms don't even have doors & no privacy shades were in use for my own safety, lot of good that does. All allegations of wrongdoing, remarkably occurred, in the exam room closest to & immediately adjacent to the busy Correctional officers & medical staff desk. Of these allegations the 1st was the 5', 220lb prostitute that said I asked if she gave good XXX. I did not recall everything said to her, but fearing they had it recorded as everything is hidden cameras & supervision, I did not want to say I did not when maybe I had. I remembered thinking, wow, she's a nasty looking hooker. She must not get much work. Maybe she does give good XXX. I did not admit to saying it, but remarked that I did not recall. So, after one person alleged wrongdoing, officers went out on a witch hunt & found 2 others with similar complaints.

Imagine that, unlikely since 3 are now saying the exact same thing? Probably not, wow, though they are all 3 from the same little-housing pod. All 3 of them could have conspired at any time when in open areas during free time, or when transported to other areas being housed in same room at same time. The jail houses a large number of inmates at a time, none of the hundreds of females in other areas of the jail made similar claims. Only 3 career convicts on the same block of the jail. 2 from a local prison where a correctional officer was being prosecuted for having sex with prisoners. Wow, wonder where their original allegation ideas came from. Questionable... that all 3 passed MANY other correctional officers, medical staff, etc, walking HUNDREDS feet, going through MANY MORE locked doors before anyone cried wolf. Then after 1 cried wolf, 2 others were hunted down who cried wolf weeks after their claims of wrongdoing. Thank you, to the few who spoke in my defense. I am innocent, maybe I am clumbsy & bumbed a boobie when pressing sticky EKG electrode patches on urgently (treating false claims of CP) but per AHA protocol 12-lead EKG stat (female present)! The other cry's of wolf from possible clumbsy stethescope assessment of APT-M heart sounds, Apical, Pulmonic, Tricuspid, Mitral, because with healthypeople.gov 's leading health indicators state that heart Dz is one of the foremost problems for what... obese-hispanic-americans? All of which were the target audience. I never admitted to any wrong-doing because it did not happen! I merely said that I touched them in assessment, feeling pulse, listening to lung sounds, heart sounds, general head-to-toe assessment criteria. Then I was indicted on what, "Probable cause"? If 3 inmates say it's true, it must be true? I think it would likely be more improbable, but what do I know, I'm just a sex-crazed-nursing-handmaiden, like the one's that play on Gray's Anatomy, or ER. They are always sexing it up so I must be too, is that it? I was when alleged, a very happily married man with my 1st born just 3-months-old. Everyone there at the jail knew that too, I was happily showing ultrasound pictures, I just had maternity leave. I was respected by the staff as a hard worker, but you know when someone needs a fall guy, who are they gonna fall...a girl? At least 2 out of the 3 career felons had also had Charges of "False Reports to Law Enforcement", but hey let's ruin someone's career! I found there are many limitations in place for defending against such obvious heinous allegations, what were those again, ouch he pinched my booby, but I didn't really feel it until I walked calmly past 8 guards, 4 nursing staff, 10 inmates & then it came to me..."Cry Wolf"! OMG, please get all the facts before the verdict, thank GOD the jurors can smell a stinky fish wrapped up in Convict-clothing better than my own, well-knowing family of other supportive healthcare staffmembers. Pray that your not next!

Really, the girls said I "flicked & pinched their nipples". When I was originally deceived into questioning, it was only because 1 girl claimed misconduct. I don't know what you all know about pinching & flicking nipples, but it neither gets me off, nor is it something I would believe anyone would either enjoy, nor endure without crying for an officer who is merely seconds away at any given time in a jail. Another factor is, from my own experiences with ladies (rather limited mind you) whenever I have thought maybe they would like me to pinch, never tried to flick their nipple, does it sound enjoyable to you, I have been unimpressed with its usefulness in intimacy. I would be so bold as to compare it to punching a guy in the face. I don't know too many guys who would take that lying down, or sitting as it may be, and not scream, kick, & shout for immediate help in a law-enforcement, Sheriff's Department-run jail facility. Doesn't that strike you as odd? Not one time, but 3 times as we are supposed to believe, and only 1 victim reported within the 1st 24 hours. I mean for crying out loud, no investigation done other than believe them, when anyone at a computer could track down their multiple felony convictions of dishonesty & various criminal charges of: "FALSE REPORTs TO LAW ENFORCEMENT". Be that as it may, my attorney could only introduce felony convictions into my honest defense. He could not report the substantial amounts of charges that did not result in felony conviction. The career criminals get breaks though, they go into courtrooms with numerous charges that are either withdrawn, or dropped because taxpayers do not want to pay their room & board for a great many charges, only the worst of the charges. But alas, most were already DOC prisoners confined on heinous convictions, housed in the jail for courtroom hearings already, no need to charge them anymore. They were already confined. Cop's just want to convict you and score points, innocent, or not, they do not care if they are right. Remember, you may be next, or maybe you are recovering from the same.I always provided the best care to my clients. I have gotten compliments & letters of appreciation from past clients. Oftentimes putting up with obscenities, unwanted advances from disgusting prostitutes and calling CO's to remove violent & vindictive inmates from medical assessments necessary to ensure inmates did not die from unknown health concerns, or mismanaged chronic illnesses as were frequently found in general assessments. The inmates were famous for faking seizures, lying about various narcotic drugs they reported they were taking as prescribed for chronic aliments and expected to continue at taxpayer expense. Those naive to corrections work would not know this, but those in the know would be less likely to ruin someone's life, let alone a hard-working newborn's father's life based soley on "She said/he said". Who had the most to gain? Who had the most to lose? I would not risk my career, my livelihood, nor that of my family's for 10 seconds of flicking & pinching some fat, ugly prostitute's criminal nipple. There was no evidence to support their claims, or they would have claimed rape, but that is harder to Cry Wolf on. Then they would have to support their case with tears, abbrasions, or DNA evidence which is not present because nothing happened other than some inmates, with loads of time on their hands, conceived & manipulated unknowing law-enforcement recruits into believe their false claims of fame.

Many of our residents in jail were detoxing from many drugs & chemicals. One main side effect of most drugs is crawly skin, or creepy crawly sensations. The 1st complainant was there for many drug charges. She said she got picked up because someone offered her Meth if she got in the car with them, later she was arrested for soliciting prostitution. One of the assessment parameters is referring inmates to other practitioners for STD checks, is if indicated. So, I improvised my assessment strategy asking her if she would be willing to meet me outside of jail for services, she agreed, so I moved onto assessing STD testing needs that I usually skipped unless indicated. I often skipped those questions, unless indicated, due to awkward nature of questioning and sheer volumne af arrestees processed daily. If it was not indicated by charges, appearance, or complaints, then it was best left to nurse-sick-call requests from inmates themselves to keep the flow of productivity continued. Accountability is a soverign expectation from nurses, nobody ever asked me if I had any defense & then there was only so much that could be introduced into the court room when not specifically asked. Gosh, & I got into this field to help people, I did not intend to help them out of jail by framing me for something to minimize their own wrongdoings. I'm a good guy with nearly 20 years healthcare experience as CNA, EMT, Student nurse & RN, certainly no wacko that caved in after so many years in assisting folks to become the serial-nipple-pincher, does that really do anything for anyone? Why would someone be so desperate to believe that? I have had very pretty girlfriends, i do not need to risk life, limb & familial happiness to get a pinching fix, c'mon how desperate do you think someone could be? Sure, I know if I was career convict I could be desperate for a get outta jail free card. The hooker got her charges dropped, arrested several months later on new drug charges, why would she cry Wolf? Newspaper could report that, but is that really as interesting as jail nurse fondles inmates, not "HOOKERS" or CAREER CRIMINAL, but defenseless inmates. Where are my rights? Defamation of the

Acquitted - Some Advice
Due to the presumption of innocence we are all supposed to accord an accused following a not guilty verdict, please do take care in suggesting and stating any disagreement you might have in regard to a court's decision. Defamation is a real possibility in such instances and the defamed can sue the blog/site owner, in some instances the ISP, as well as the comment poster.
Be aware that you can defame someone when you suggest or allude to your meaning as the court can imply both identity and meaning; if you have written it cryptically so people will get it without you saying it directly what makes you think that the court won't?
Stating it is your opinion is not a defence unless you can show your opinion is reasonably held and even then, unless you have the money to prove your defence in court it is wiser to not go there and to respect the presumption of innocence - you were not in that court room afterall. Don't rely on a plaintiff's broke status, that they won't be able to afford to drag you into court; lawyers are far more willing to do pro-bono work when their client is legally famous.
MandM do not moderate comments and allow anonymous contributors; however, as with spam, any comments posted on this blog that are defamatory will be deleted; legal defences for permitting publication of a defamatory viewpoint are much harder to succeed with. I suggest other bloggers watch their comments for this issue and be aware that even if you promptly delete it, you can still be sued even though you didn't write it.
From all of the above the so called "chilling effect" of defamation can be seen. Effectively what I am saying is that if you criticise the court's finding or you claim the court got it wrong then effectively you are saying that the accused that the court ruled 'not guilty' is in fact guilty and you step into the realm of defamation law. Whilst I support the concept of reputation as property that one can defend at law, as reputation can directly affect the pursuit of life, liberty and happiness, I also support freedom of expression and the principle of openness and further, I strongly oppose a system that effectively renders the courts as infallible or unquestionable.
Even though defences to defamation do exist that can, in some instances, support questioning of court and jury decisions, such as:
honest opinion - must be reasonably held,
truth - because defamation is a civil action in New Zealand, this will be held to the balance of probabilities, not reasonable doubt;
These defences are expensive to mount, you could easily run up a legal bill of $20,000 plus and there is no guarantee you will succeed, most of us don't have a spare 20k to throw at the things we say online so when confronted with the risk of having to we err on the side of caution and cede too much of our freedom of expression and our right to open trials; hence the chilling effect of defamation law.
However, rather than do away with defamation law or deem reputation to not be a form of property - I think requiring people to think about not harming others before they open their mouths is not that unreasonable a limitation on freedom of expression - the problem could be solved by a revamp of how the law works. Either publicly fund access to justice so you can defend yourself when accused and protect your property when it is attacked - judges could keep a check on frivolous actions or make defamation a criminal offence, which would achieve the same thing.

Just read in paper the other day inmate received $3.6M in damages from allegations of sexual abuse in prison. I know there are people who should truly benefit from this, but what about the hundreds of false allegations that will follow after such a jackpot? The system is broken, no doubt, what can be improved?

More data to support my false allegations, why was it so easy to ruin my career? "Ruth Teichroeb of the Seattle Post-Intelligencer reports on sexual misconduct by employees at the SeaTac Federal Detention Center. "At least 20 sex-related incidents involving correctional staff and inmates have been reported at the prison in the past five years, according to Department of Justice records obtained through public disclosure. The allegations ranged from groping during pat-downs to forced sex. Yet not a single Bureau of Prisons employee at the facility has been prosecuted for sex-related crimes during that period. "FEDERAL STATISTICS SHOW THAT SEXUAL ABUSE BY CORRECTIONS PERSONNEL IS THE MOST COMMON COMPLAINT ISSUED BY INMATES NATIONWIDE".
