After decreasing for a decade, on-the-job fatalities on New York construction sites increased last year, from 81 deaths in 2007 to 90 deaths in 2008. Steven J. Schwartzapfel This data, released Oct. 28 by the U.S. Department of Labor, indicates the greatest increase in work site deaths resulted from falls, which claimed 29 lives in 2008. "This loss of life is needless and unacceptable," said New York attorney Steven J. Schwartzapfel, founding member of Schwartzapfel Truhowsky Marcus P.C. , a personal injury law firm. "Unfortunately, certain contractors and employers fail to follow the law which provides for the safety of all construction workers." In New York City, 31 workers died on job sites in 2008, an increase from 24 in 2007. The new Labor Department report, which was featured in the New York Times, indicates the rising number of deaths in New York is in contrast to the nationwide trend. Across the country, work site deaths decreased by more than 10 percent from 2007 to 2008, and the number of fatal falls was down by more than 20 percent. "There is no excuse for the dangerous job site conditions faced by New York workers," Mr. Schwartzapfel said. "Those responsible will be held accountable."
