The developer that planned to build a Pathmark grocery store in lower Manhattan four years ago has asked a New York bankruptcy judge overseeing the Chapter 11 case of Pathmark's parent, Great Atlantic & Pacific Tea Co., to recover some of $6 million they had put down before the deal fell apart.
