Federal regulators have notified Beazer Homes USA Inc. that its top executive could face civil charges over incentive compensation.

Atlanta-based homebuilder Beazer Homes USA returned to profitability in its fiscal year fourth quarter, posting income from continuing operations of $35.3m, or $0.87 per diluted share.

Among the companies whose shares are expected to see active trade in Tuesday's session are Tyco International Ltd., Beazer Homes USA Inc.

Pulte Homes Inc. lost $361.4 million in the third quarter, but with the acquisition of Centex Corp., the homebuilder's new orders increased by more than a third.

Last year, the firm recorded a loss of $473.9 million, or $12.29 a share. Revenue dropped to $376.3 million, from $649.8 million a year ago.
