Your time is up. Your way is slowly destroying this State. There have been cities that subscribe to your philosophy so we don't have to conjecture what can go wrong if we continue with property rights -- applied to the extreme. Here's the problem. Developers with connections to the good ole boys in town, will push property rights law and challenge local government. Generally, local government will buckle, either because you have commissioners who subscribe to the property rights madness, or because the city doesn't want an expensive battle in court. It's uncertain how that will go these days, especially when the judge's background may not be all that objective. So, because the city won't play an active role wherever there are strong challenges from these people, strange things happen. For example, where there may have been a bankruptcy and several replats involved, new homeowners are at the mercy of old homeowners to tell them the status of the Association. And it is not unprecedented that a small detail is left out, like the turnover of the Association. Oddly, the good ole boy in the Association who signed the turn over, claims he didn't know a turnover was taking place, and he has an old city attorney and a good ole boy private attorney to back him up in that confusion. The city doesn't feel it's their responsibility to do due diligence, so a homeowner is left reeling, realizing he's not in Kansas anymore. It's a property right's law environment afterall, just like you wanted it to be, and government has no teeth. So, when the final replat takes place, those that know this information have a blank check, as the new homeowners are virtually contained. So, with no one around to put up a fight, property rights developers and subcontractors are able to show us what they are capable of doing when they have no one looking over their shoulder. They build terrible infra-structure which passes on to the homeowners. The city won't stop them, because it's a property rights environment and they don't believe in it's their responsibility to do the due diligence, or worse, they knew and were part of the charade. When a homeowner comes and tries to sort things out, they have been told that the city is not legally responsible for anything that went wrong and they have to take things up with the developer. Worse, they'll claim that it was a PRIVATE development; therefore, the homeowner isn't a member of the public, and thus, does not fall under the city's purview. This is how property rights is being applied in Florida today. And I can tell you, it's not making for happy communities. |

We can believe that what we do with our property does not affect anyone else but it is false religion. You may care, the courts and commissioners may care but the earth does not care and will abide when we are gone. In other words we are all in this boat together and collectively we must have a say. Growth use to equal progress but no more.

Will Jane Healy please get a real job sometime soon? Her Slantinel blathers are usually so biased as to be laughable, especially in support of ScamRail. Today, however, her opinion about curbing growth in Orange County actually made sense. Maybe there's hope for her?

If you want to stop growth, cancel the the Wekiva Parkway. It goes through over 50,000 acrs of farmland and natural areas iin Orange County.
I just drove on the John Land Expresswway that takes off from I-4 in Maitland and ends up taking your west around Orlando and Disney. What do we need another beltway for? More importantly this new road is also a useful commuter road. The Wekiva parkway is not. It is for encouraging Orlando's growth industry - growth. Lets write about that! |
