This so called vigilante got a call that his business was being robbed. The police received the same call. Why on earth couldn't he wait for the police to handle it? While the burglar was definitely wrong, there was nothing in that rinkydink little store that warranted having his life taken away. I hope the commonwealth attorney looks long and hard at charging James with at least manslaughter.

according to an article in the virginian pilot this morning, Durden smelled of alcohol and failed a breathalizer. He was still drunk at 4am? Just what Whaleyville needs; Another redneck drunk with a gun.

Here is another article on this story (http://hamptonroads.com/2009/06/police-man-ki... ).

So a repeat parole violator and drug addict breaks into a store, not armed with a gun, but a tire iron. Because it is 4:00 in the morning the store is dark, and the owner says he sees the robber point something at him through the window. If that is indeed the case and the robber was trying to scare of the owner...he made a fatal mistake. Sorry, but a tire iron pointed at someone in the dark could look A LOT like a gun, and the benefit of the doubt goes with the store owner. The owner's wife was also there, so it appears the owner was justified in protecting himself and his wife from this P.O.S.

The police report says the tire iron was used to break the window and wasn't located anywhere near the body. this is a sad situation for all involved. I don't think the store owners family was in jeopardy unless they were sleeping inside the gas station. If he was so concerned about his wife's safety, he should have left her at home.

The police got the same call and the owner shows up first... that tells you something about the efficiency of these police you rely on. I commend the owner. I love when criminals are killed by armed citizens. News flash, if you don't want to die, don't break into people's private property. I hope they give him an award. Screw the police, they are just armed criminals with a badge and government thugs.

They will "investigate" the claim. In other words, they write down his info on a government form and throw it in a pile which will eventually be put into a filing cabinet if it doesn't fall into the trash first. Your tax dollars hard at work. Meanwhile, the criminal is out repeating his crimes. I prefer the criminal just be permanently removed from earth, just as happened here.

He didn't "get a call". He had a baby monitor in place and heard the disturbance. He beat the cops there because he lives across the street. And you are right, there was nothing in that store worth the burglar's life...so the BURGLAR shouldn't have put himself in that situation. The man had every right to defend his property and livelyhood. Do you always blame the victim first. I suppose it's the raped woman's fault if she shoots and kills her rapist isn't it?

If you do not want to be killed, do not commit crimes against others. There's a whole Bible verse about it being okay to kill a theft who comes in the night. I guess God wanted this mook dead. The shop owner was just doing God's work. Go riddance to bad rubbish.

If he was that drunk and impaired how the hell did he hit the intruder, lucky shot? It was a lucky shot for the folks in Whaleyville. One less dirtbag roaming the streets.

They are two different crimes, but they are both crimes committed against another individual. This idiot is dead because he made the decision to rob the wrong store. HE put his life in danger by choosing a life of crime, not the store owner.

This is all going to come down to how much he had to drink, what his BAC was at the time, and if he can prove that he felt as if his life was in danger. Another problem is how our laws are written. I suggest that every business owner who chooses to protect his or her property by deadly force needs to make sure they know what the law states before doing so. It can be rather tricky and side on the side of the criminals at times. So many things to think about and look for in a split second before you take that shot. I had a conversation with someone the other day about drugs and how they should not be against the law anymore because no one that does drugs really ever breaks the law except for doing drugs. What happens when you have spent ALL of your money on your drug of choice and you start to withdrawl? You go find money any way you can.

And then you are shot and killed (such as this case) and nobody has to worry about you or your habit anymore. This is far better than spending countless millions of our tax dollars on a failed "War on drugs" to boost political image and justify useless government positions (complete with too high pay, benefits, and pension... paid for by tax dollars).
