Judge throws out man's malicious prosecution lawsuit
A judge has thrown out a St. Johnsville man's malicious-prosecution lawsuit against the Montgomery County Department of Social Services, saying the plaintiff wasn't prosecuted in the first place State Supreme Court Justice Joseph M. Sise granted the county's motion to dismiss the case brought by David Hayes in a seven-page opinion signed Oct. 7.
