1 Believe me after the court dust settles the Osburn family could own part of the farms. A friend of mine suffered permament physical disability from an accident, and the court awarded her well over a million. |

"If" the County left the gate open.. partial liability, however it would still be up to the land owners to secure the horses in a pasture known to be fenced properly. If the owners had knowledge of the work being done by the County that day, then they should have either moved the horses or determined the risk. I can't imagine they intentionally ignored a down fence. Horses are not a cheap hobby. Especially polo ponies.
Also, did this person not have insurance? It will be years before a judgement will be made to determine fault. In the meantime, according to law..it will be up to him to pay his medical expenses to date. |

I have been wondering since the news broke about the downed fence, why the "caretaker" did not confirm that the fence was repaired. Sounds like someone was asleep at the switch. Not saying the county and the fence company aren't at fault, just that there is plenty to go around.
Man, if this guy did keep the money for his mother's medical bills, that is pretty low. I wouldn't be able to live myself if I did something like that. |
