New Mexico politics: Videos expose gun show loophole

Full story: Las Cruces Sun-News

By now, anybody paying even scant attention to current events has seen the undercover video of the two young, conservative activists dressed outrageously as pimp and prostitute getting advice from ACORN workers on how to game the system.

1.A private citizen buying sporting goods with their own money is not like a national radical left wing organization with ties to the most powerful postion on earth, stealing multi-millions from the U.S. taxpayer, and committing election and loan fraud in a widespread systematic manner.

2. Get rid of background checks. We never needed in our 200+ years prior to them being passed. Why, as free men, do we need them now? Background are arguably unconstitutional. Gun control isn't about guns, it's about control.

Shut down ALL gun shows. Unlike ACORN which violated no laws with the whor & pimp, these videos clearly show law breaking behavior.

Just like Acorn if the law was broken then prosecute to the fullest!!! If there is a systemic history with those sponsoring these particular shows then prosecute the sponsor, just like ACORN. Do not prosecute all that are involved in like services. In other words even though ACORN is under investigation don't take funds from the NAACP likewise because some gun shows are lax don't shut them all down.

How about enforcement of the laws we have rather then new laws. Making new laws when we can't enforce what we have makes no sense. After a few of these bad actors are prosecuted to the fullest extent of the law the rest will get the message loud and clear.

In all cases these folks broke federal and or state law and that should be acted on.

Where is the outrage from the left about people being filmed without their permission:-)

While we are at it, let's also shut down talk radio, right Roy? So let's see, you and your iliberal group are trying to take care of the 1st and 2nd Amendment. But iliberals fascists will make sure it is okay to pay for babies to be killed via taxpayer dollars and "Health Care Reform". You better enjoy it while it lasts Roy.

"...federal law that bans sales to a person the vendor has reason to believe would be prohibited from buying a gun...."

This is very similar to a person lying about their income in order to receive a loan that thye can't afford. In both cases, the vendor/loan officer probably knows that something is fishy, but is too tempted by the profit to say no. Ditto on inflated appraisals.

The only way to stop this is to have law enforcement do stings, just like police set up stings to nab prostitute, johns and exotic dancers offering more that a dance. I don't know what the penalty is for violating this federal law, but it needs to have teeth, such as confiscation of the vendor's wares, just as drunk driving will get your car impounded. Only then will anyone pay attention to the laws.

After typing all this, I went to the NYC.gov/gunshow website, and recommendation #2 is contains what I described. However, that recomendation also incudes a statement that ATF should "actively identify whether recovered crime guns were purchased at gun shows". The only way to do that is to retain the sales information indefinitely.

Shut down all restaurants because they serve obese people.
Shut down all bars because they serve drunks. That's illegal in some states.

Were any of the gun dealers getting taxpayer stimulus money, and grants like ACORN?

I am a proud gun owner who is concerned about criminals. ALL OF THEM NO WHAT PARTY SUPPORTS THEM. Geez, some of you people are truly out there. Why does everything wrong have to have a comparison that justifies it? If it's wrong it's wrong. Allowing guns to get in the hands of criminals is not something you can rationalize. It's irresponsible. Allowing federal money to go to operations that misuse it is also wrong.

I won't buy a gun unless i can lock it up if I'm not at home. To that end I am forced to sell off some to buy others. I only sell to people I know have had back round checks exceeding those needed to buy from dealers. To stop person to person sales would just mean penalizing responsible owners for the actions of people that should be prosecuted.

There are a lot of items that you can't sell yourself but have to get from a licensed dealer. Why should guns be different? I can't resell my prescription meds when I don't need them. Even if I know the person I'm selling to has the same condition as me.

Say we make dealers the middle man on sales and THEY can be held responsible if there is a problem. Just thinking out loud, so don't go too nuts on me. If gun owners don't agree on something to control it we're likely to suffer a much greater erosion of rights.

Meds and such are not a right in the constitution. The SCOTUS is now figuring out if the second amendment is applied to the states or not. Right now regulation of gun shows falls into the preview of the states. You cannot ship guns across state lines unless they are shipped to a licensed dealer. You cannot ship person to person. Not sure if a private owner can deliver a gun from out of state which would apply to person to person sales at gun shows. The problem arises in the cost. I know of one dealer here that charges $100 just for processing a shipment to him because you don't buy the gun from him with his markup. I, personally, would have no problem with going through a dealer if they had a set rate for it that was reasonable but that won't happen and it would also be another restriction on the 2nd amendment that I know other reasonable people would rightfully fight. Every time the congress gets a foot in the door they add amendments that go hidden to make it all encompassing and highly restrictive.

the self limitation of rights in order to prevent the erosion of rights is still a loss of rights provided in the constitution

How do you do this, unless you are a member of law enforcement using national and state databases for personal uses?

I sell to people I personally know...if they have a Concealed carry permit I know that and the back round check is beyond the norm. If I work with them I know the checks necessary for the work we do and that it is way way beyond the ATF checks. I would never advertise and sell to someone I do not have personal knowledge of.

Thanks, I did not consider the requirements for a concealed carry permit.

So how do we make it easy and simple for a private owner to sell to another person, without forcing exorbinant fees or throwing the door wide open a national databse of gun owners?
