A district court judge has nixed a suspended Robinson Middle School principal's bid to have his third drunken driving arrest tossed after the judge ruled Merrimac police had probable cause to arrest Stephen C. Gross.

While Lowell school officials remain mum about suspending the principal of the Robinson Middle School earlier this year, court records indicate Stephen C. Gross was placed on paid leave shortly after he was arrested for his third drunken-driving charge.

Police say the vehicle was headed south on the highway in Merrimac just before 2 a.m. when it left the road, rolled over and struck a tree.
