Suit over commercial complex set for US court in 18 months

After spending some time in legal limbo, a lawsuit challenging Sussex County's denial of a controversial coastal-area commercial complex is moving forward again, with a trial scheduled for 18 months from now. The suit over the Townsend Village Center project was moved from state Chancery Court to federal court in the fall, effectively restarting the process. But U.S. District Judge Mary Pat Thynge set the case schedule Friday after attorneys for the county and developer L.T. Associates offered a proposed timetable. Thynge scheduled a three-day bench trial to begin Aug. 13, 2013, more than four years after the project was filed with the county, court records show. The proposal from county attorney Vince Robertson and developer's attorney Dennis Schrader also left the door open for a possible settlement. A status conference is set for December, with key motions due Feb. 15, 2013. The fight centers around a 300,000-square-foot commercial project just outside Lewes on a 45-acre tract across from Cape Henlopen High School. It brought out hundreds of residents in opposition in 2010, expressing concern about the traffic impact and how it would change the character of the town. Sussex County Council voted 3-2 to reject the plan in January 2010, and L.T. Associates appealed to Chancery Court in March of that year. But last fall, the company said in a court filing that the federal court, not Chancery Court, had jurisdiction, though it had pursued the suit in state court for a year and a half. The developer argues that the council's decision was not supported by evidence and that Councilwoman Joan Deaver, D-Lewes, who represents the area, should have recused herself because she met with an opposition group, appeared at a protest and encouraged the opposition, calling those actions an abuse of her power. The county has denied that, saying Deaver did nothing wrong. She met with members of the Managing Growth Around Lewes group but left the room whenever the project was discussed and did not take part in any protest, the county has argued in court papers. Also, a county attorney pointed out that even if Deaver had recused herself, the complex still would have gone down to defeat with a 2-2 tie. L.T. Associates had originally applied for a zoning change for a larger shopping center, about 572,000 square feet. But the company withdrew the application in December 2008 after the county planning commission voted unanimously to recommend denial. Opponents included Lewes City Council and Beebe Medical Center, the latter expressing concern about delays for emergency patients headed into town.
