1 snip: CHARLESTON, W.Va.-- The state of West Virginia tried to kick her out, but a judge has ruled that 77-year-old Helen Shank gets to stay at Golden Living Center in Morgantown. Kanawha County Judge Tod Kaufman ruled on Wednesday that Medicaid must continue providing nursing home care for Shank, who is mentally ill and also a "brittle diabetic," according to court papers. Kaufman overruled a decision by the West Virginia Department of Health and Human Services to take federal Medicaid benefits away from Shank, despite recommendations by several of her physicians and psychiatrists. The case could have implications for other seniors with mental illness living in nursing homes, according to Shank's lawyer, Daniel Staggers of Keyser. Shank has lived in the Golden Living Center since October 2004. But last year, a DHHR evaluator said she no longer qualified for nursing home care. The DHHR decision to deny Shank long-term care benefits was upheld by State Hearing Officer Thomas E. Arness on October 20. After that ruling, Kaufman issued a retraining order against DHHR on December 26, preventing the agency from taking Medicaid benefits away from Shank while her legal appeal before him was pending. ---------- snip: DHHR can appeal Kaufman's ruling to the state Supreme Court, but has not done so yet. __________ Other legal positions that may be considered is that the medication over the years caused her diabetes and dementia. That may be forth coming in the lawsuit. She won't be able to sue the State of West Virgina but the State could be ordered to take care of her for the rest of her life. If a wrong diagnoses was made by an independent mental health advisor to the state the independent advisor would shoulder the financial responsibility. |

1 If its an industry problem, then you shouldn't be trying to hijack this thread about a specific incident. If you want to call someone a fraud, grow a pair and actually do it. You won't be found guilty of libel if the wog courts agree with you. |

1 Not parinoid at all. Not a Scientologist. I mentioned this before: There has been "No" biological defect found for any mental illness or any of the other made to order diagnoses by any neurological study. Without a test for chemical imbalance the mental health (psychiatry) is limited in the ancillary tests of medicine like an EKG, EEG, blood work or other tests in the diagnoses of a patient. They aren't needed in Psychiatry. The psychiatric diagnosis is made on the basis of behavior and hearsay. If we respect metabolic changes based on daily dietary habits, weight gain / loss , terms of the survival of the organisms as a person age along with physical conditioning, physical illness, electrolyte level, gender differences , body temperature, I don't see where the Mental Health and Counseling Industry could conform to any consistency in data with consideration to the above to state a person has a mental disease or illness based on chemical imbalance. Psychiatry is not recognized in the sciences.
