It is always "Two beers", never a six pack or twelve pack....same out here, they all say "a couple of beers!" Geewhiz, if you can't handle "two beers", don't even think about it!

a dui with less than a .08....haha...that will really hold up in court.... hope he doesnt file harasment or civil rights for an illegal arrest.....jus give him a ticket for being stupid and go about towing the vehicle

I don't know about you all, but I'm sick and tired of these drunks. Insurance is too high, and the roads are to dangerous.
My opinion, first offense DWI/DUI should carry a $10,000 fine and a year in jail.

We have made our county what others wish to make it. We need toleration for those who are responsible but to blanket everyone in the paddy wagon is not the way. We need a strong blue collar base and lawyers and politicians who remember those who may drink to have them support getting rid of these police state laws. A study by the National Highway Traffic Safety Administration found California Statewide DUI deaths decrease from 2005 to 2006. Texas leads the nation. So why are we so puritanical?

HELL YEAH!!! Besides DWI/DUI is not a "mistake" Everyone knows the danger involved. They just don't care. Take this scenario for example; A person gets drunk and takes a gun and starts taking shots at cars driving by. How many years would this person get? Now what is the difference between a gun and a car in the hands of a drunk.

dwi........dui........i know ppl who have had their 4th and all they get is probation and the interlock on their vehicle....if this is such a problem why are the laws so lame?? i mean ppl are dying cuz someone wants to drive after havin one too many or just a little. i say the laws suck and they should be rewritten or typed or whatever!!!

If everyone who was caught and convicted of DWI/DUI and imprisoned for upwards of a year, that would result in the county jails and state prisons being filled with prisoners. And who picks up the tab?? Taxpayers. Taxpayers will have to pick up the increased tab for incarcerating more people. Not that I'm saying that DWI should not go unpunished, but some sort of balance be struck in upholding and protecting the law and rehabilitating offenders.

Granted that in this case crashing into the tree will make it likely the guy will get convicted.

That is where the $10,000 fine and cash from car sales will come in. Also while in incarcerated make these people work for their keep. It's not a country club. Anyways with that type of punishment; I think many people will think before they drink and drive, and the problem will start to faze out

Instead of selling the car at auction and or jail time, just chain them to their stupid car and let them live out of it for their sentence. If anyone cares enough about the losers they can throw them some food every now and then. That would probably work better than "treatment".

The point of law here is the nut crashed into a tree and will get punished for the full extent of the law. He violated the tree's space, he didn't crashed into it to hug it. Now if he had crashed into a SUV, he would have been treated as a hero. Just ask our liberal friend, Matth Thomas.
