Judged:
1 With most game being at the highest level's in years there is no reason to hunt from a car or atv. |
||||
As a hunter also, I agree with you, I also hope they get the MAX |

|
||||

Losers... Doubt that much more time will pass before these guys commit a very serious crime and end up in prison for long terms. They're threats to society. Wish they could be put away right now.

I think this is probably alcohol fueled idiocy. These guys are in big trouble, and deserve to be appropriately punished.

What does the Alledged hunting violation in May have to do with any past possible crime of Holmes or anyone else cited in this story? Why did it take from May 26, when they were stopped with no illegal game to July to be arrested? Traffic accident 2 years ago, has absolutely nothing to do with this supposed hunting violation. Something is definitely wrong with this story. Anyone get the feeling Holmes is being targeted?

This is very poor jounalism. Did the DA take up a second job. Clearly, this article was inspired by the DA, or someone likeminded. They are two completely different incidences unrelated to eachother. Its almost as if someone on the inside is purposely trying to target Holmes. This statement has nothing to do with Holmes guilt or innocense, it has everything to do with the poor judgement and unprofessional journalism. Mr. Welter, you really need to re evaluate your skills.

"Department of Fish and Game Lt. Sam Castillo said Cody Layne Gregory, Derek Holmes, 21, and Whitney Word, 21, all from Elk Creek, were observed using spotlights to hunt game from all-terrain vehicles at night.
Castillo said a game warden witnessed the violations and none of the suspects had game with them when they were detained." If I am reading this quote correctly, no crime was committed. So it sounds like the Sherriff down in Glenn County is grasping at straws for reasons to put these youngsters in jail. Since when is it against the law to drive an ATV after dark with a spotlight? The article said they had no game with them, so I am wondering exactly what are they being charged with? Maybe they were just doing stuff that was entertaining like playing flashlight tag on quads. Not much else to do in Elk Creek. I think we should give them the benefit of the doubt until it is proven they were doing something illegal. They don't deserve to be wrongly accused, or judged by all you people who posted above me. Wouldn't you want fair treatment if it were yourself or someone you cared about? And no, I don't know any of these people, but I have known someone who was later, after a long and lengthy trial, found to be wrongly accused and it ruined their life. |

My guess is they had guns with them |

Don't worry about Derek Holmes. He is well connected to law enforcement. Read July 4 Sacramento Valley Mirror for more details on violations.

This is still crap. Its out of season hunting from a ATV and I am too guessing drunk.
This type of poop gives real hunters a bad name. I know some people think hunting is bad which I don't agree with. But people like this do not speak or act like normal hunters. I know for a fact that a real hunter out doing there thing would be pissed to no end and would be making a call. We do not like this crap and more than Peta. I really hope they are all banned for life and there gun they had on them were taken and destroid. This type of hunting is not a sport but a useless slaughter of animals. People like this should be tagged and preyed on. I know there is a few up here in Magalia who have been bow hunting not far from me where there is about 30 to 40 deer on a huge 40ac lot. I have seen the headlights at night and I have called it in. I have gone back in the day and seen evidence. Fish and Game and others are on to you and I would stop. |
||||
Even if they had guns as long as they hadn't shot it, no crime committed. If I was out after dark in Elk Creek I would have a gun too. Protection from coyotes, dogs, weird people etc. |
||||
If you take aim from a car or atv is a crime. If they were in a park or wildlife area with a loaded weapon in a car or on a atv its a crime. If your drinking and have a weapon its a crime. To use spot lights to hunt game is a crime. To hunt after sun down is a crime. Doesn't take much to upset Fish and Game. |

Richard, Thank you listing the laws against hunting at night. F&G 263 and 264 for Glenn County.

Here is the F&G section which at least Mr. Holmes has been charged:
"2005.(a) Except as otherwise authorized by this section, it is unlawful to use an artificial light to assist in the taking of game birds, game mammals, or game fish, except that this section shall not apply to sport fishing in ocean waters or other waters where night fishing is permitted if the lights are not used on or as part of the fishing tackle, commercial fishing, nor to the taking of mammals, the taking of which is governed by Article 2 (commencing with Section 4180) of Chapter 3 of Part 3 of Division 4. (b) It is unlawful for any person, or one or more persons, to throw or cast the rays of any spotlight, headlight, or other artificial light on any highway or in any field, woodland, or forest where game mammals, fur-bearing mammals, or nongame mammals are commonly found, or upon any game mammal, fur-bearing mammal, or nongame mammal, while having in his or her possession or under his or her control any firearm or weapon with which that mammal could be killed, even though the mammal is not killed, injured, shot at, or otherwise pursued." Note subsection (b) where it discusses the casting of light while having control of a firearm or weapon. |
