A fine accomplishment, second highest in the state. All the republicans, including the elected ones, must be so proud. All those who voted for this crap should wear it like a badge until the next election when hopefully we'll vote in real conservative people instead of party patsies.

Attorney H. John Underwood must be pretty proud of his high profile backing for the Race Track License to Steal Tax soon to be imposed on the residents of Lincoln County. Second highest in the state? That's some accomplishment!
Socialism for the Rich and Free Enterprise for everyone else. That's the winning ticket!

How ignorant are we? Second place. Maybe we ought to spend some of the collected Lodgers tax to inform tourists of the fact they will spend more on their trip if they visit Lincoln county. That'll bring 'em in.

Here is a ? I wonder if someone knows the answer to? At what point when you win a jackpot do you have to pay gross R T on it. 1000,00 500,00 ever? or is the racino exempt from this tax or is it income tax?I would really like to know.Shouln`t the county be taxing winnings at the racino insted of all the consumers paying the taxs to support the racino?I`m sure I don`t know enough about this tax system, but it seems backwards to me,especially when you factor in all the extra police expence and crime generated around the track.

If the person has net winnings it is taxed by income tax. They are not buying anything.

Fight fire with fire...errr, well spend your dollars else where. Like a number of you, we too shop in Alamogordo and pay less for gasoline and taxes on goods. Gas remains very high in Ruidoso and soon GRT all because "they can!" Well, we "can too."

Are there any good credible candidates for municipal government in the community? This perverse knock off of "Spin City" where the mayor is all but required to be a dunce supported by several jesters mocking the job of trustee is too unreal for TV. What amazes me is that it has gone on so long. I suppose out-of-state owners and self interest see to that. I am truly astonished it has not run into the ground yet with the incompetence and corruption robbing taxpayers blind without the courtesy of a kiss. The backstory is "Dukes of Hazzard".

Support? Can you offer anything to support that allegation? I mean since I was the guy to detail the legal foundation for recusal of the Municipal Judge after the McGarry hearing you must have something compelling to allege that I supported them. Have a go at it.

Ruidoso has been run by the Hubbard machine for so long that people have forgotten what it was like before him. His goons,people like Underwood, Stoddard, Rimbo, Debbie Lee, Donalson, Nunley and their minions, have, in turn, put their people in place and it all just rolls along. This has been his private playground for a long time....he dribbles out a little money from his foundation to the community every year, but the bulk of it goes out of state. Let's see, a new wing on the hospital in Palm Springs? Not happening here.....we get to pay a tax to support HIM here!!! Yes, he may "live" here but do you really think he pays personal income tax in NM?
The sad thing for Ruidoso is that none of this will last forever and then what? It will most likely mourn Hubbard's demise and erect a huge statue of him in midtown and talk about the good ole days!

The legal foundation can be detailed all anyone wants. The bottom line is if the judge refuses to show up for his own trial, there will always be a gross miscarriage of justice. At least until he is compelled to answer to his bias.

The gross miscarriage was Parsons calling of the judge in the first place. There is no law anywhere that you or anyone cite that allows a defendant to put the trial judge on trial. Until you can your best shot has been a corrupt judge once again abusing her office.

The U.S. Code provides:

"Any justice, judge, or magistrate of the United States shall disqualify himself in any proceeding in which his impartiality might reasonably be questioned.
He shall also disqualify himself in the following circumstances:
Where he has a personal bias....."

So, if he fails to recuse himself, alternative actions become necessary. Code of Ethics in and of itself should be enough. Judge Roehrig did Capitan and himself an injustice all the way around, no matter how you look at it.

You may wish to consider the actual controlling provisions that are enumerated in the "Rules of Procedure for the Municipal Courts" in New Mexico law. The fact that this judge did not recuse was wrong. The fact that a long sitting District Judge (Karen Parsons) stepped outside the law to hold such a political show trial not authorized by any law is a more significant offense. All this really showed is the depth of corruption in Lincoln County and the desire of its residents to continue the practice of corruption. You get what you deserve.
