A wrongful death lawsuit alleging that a Varnell Police officer was traveling more than 90 mph on Cleveland Highway when he was involved in a fatal collision has been filed in Whitfield County Superior Court.

The son and daughter of a Cohutta, Ga., man killed in a fiery crash two weeks ago want to know how fast a police officer was driving when his cruiser smashed broadside into their father's Dodge Neon.

Orange marks on the pavement indicate where a wreck that killed a Daily Citizen carrier occurred at the intersection of Orchard Way and Cleveland Highway.

A longtime contract carrier for The Daily Citizen was killed early Monday morning while delivering newspapers when he drove his vehicle into the path of a car being driven by a Varnell police officer who was on duty, authorities said.
