Judge it!
Not a very good disguise. You need a mask you can easily remove. Magic marker doesn't conceal very well, and it doesn't come off easy.
Now, I am surprised the marker thing wasn't used as a ruse. Someone could make themselves look like they were in a fight to gain sympathy or to look less likely to be criminal.
