Law Forbidding Hire Of Illegal Aliens "Unconstitutional" | Judicial Watch

An Alabama county’s policy requiring vendors to pledge in writing that they do not knowingly employ illegal immigrants is being legally challenged for being unconstitutional and a judge could decide the law’s fate next week.

Located in the heart of the Tennessee Valley and sandwiched between Mississippi and Georgia, Alabama’s Madison County passed the law about ten months ago to assure that public dollars weren’t being used to pay illegal immigrants hired by companies fulfilling county contracts.

The anti-illegal alien pledge policy simply requires firms seeking county contracts to submit in writing that they do not knowingly employ illegal immigrants. A construction company, that recently lost a multi million-dollar contract because it didn’t abide by the policy, is suing the county claiming the policy contradicts federal law.

Attorneys for Wiregrass Construction, which was seeking a major paving deal, claim the pledge is unconstitutional and wades into immigration issues that are exclusive territory of the federal government. The attorneys assure that “every single requirement contradicts federal law.”

This is a very dangerous place for 'We the people'. Filing civil law suits is expensive and our side cannot afford to do that. Nor can we afford to meet all the law suits that are filed against the laws of a community.

We are struggling with the money supplied by Mexico City, and the money supplied by a huge bunch of foundations that support La Raza. We are looking at the money coming forward from Immigration Lawyers.. and we ARE taking their jobs away from them. For a while, and maybe now, we are dealing with effort by the State Governments to mitigate the onslaught of the citizens efforts.

I believe the only reason we are being listened to at this point is that we are voters. THIS YEAR.. but not the next one, we have to be listened to, and talked to.

We have to change the way the National Government does things. We have got to have a national ballot initiative that will allow us to instruct Congress to hire a good law firm that will craft a law that is constitutionally sound, and causes the Federal Government to ask the people what they want. Not merely in immigration, but in national debts, income tax and a whole list of things.

Until we have the law on our side, those law suits are very dangerous beasts that are also very expensive. Until we get the law on our side, the Government can summon a bogus poll and tell us a majority of the people in this country support illegal aliens in amnesty. And that little item is exactly what we should expect if we do not get leverage before this election season is over.

I was thinking the same thing!

It's already a Federal Law that employers cannot hire illegal aliens, and if the Federal government would enforce them, the states wouldn't have to! But, they should be allowed to, since it's already illegal to hire these invaders.

This simply makes no sense.

I have been discussing with George for 84 months, but he doesn't understand. I want to put crack shot 100% Disabled American Veterans on the border. Most of them have their own pickup and both automatic 12 guage shotguns, and a Remington automatic 308 caliber rifle with a sniper scope. I believe I can get them for a thousand dollars a month, and all the free beer they want to rid America of the illegal scum beaners.

That is the best idea that has been on this site. What a great idea. A thousand a month plus beer and they will come by the thousands. No muss and no fuss. If they cross the border, THEN SHOOT THEM WITH THEIR FIRST STEP, THAT WAY THEY WON'T HAVE TO BE DRAGGED VERY FAR AND THEIR COUNTRYMEN CAN GIVE THEM A DIRT NAP. They are an infected race that is bringing diseases with them. If a marxist judge rules for their cause, then put that judge on notice that we will do whatever is necessary to protect the rights of Americans. No one will miss that judge and on we go. Let us take the lawful way, if that does not work then it won't take long to get there attention.

I like your proposed result but I'm not sure hiring a law firm to write laws is wise. Lawyers thrive on confusion which results in more billable hours. To expect these people to write an airtight law is like expecting them to give themselves a pay cut. I'd rather have a middle class working person writing laws. I'm sick of lawyers.

The Constitution only applies to citizens....if it doesn't; why are the cops allowed to use the excuse of "they are foreigners" to exempt their prosecution in so many of the cases that go to court? Double-talk and treason is what it IS. Let's send the lawyers who are perverting our laws to prison too...
