Talk around Bellefontaine is poor man spent all day in Moores.If that true his bac is proven then,bartender,Moores and the owner is responsible.Cause for a lawsuit of a wrongful death.

So, anyone that sits in a bar all day and drinks themselves into a stupor can sue the bar and the bartender.

I know it's happened, but it's the STUPIDEST thing in the world. That and smokers suing the tobacco companies because they got lung cancer.

I think that there is a law in effect that states if a patron has had too much to drink, it is the bar owners responsibility to make sure they do not drive, or cut them off after so much.

If they didn't do either, then as stupid as it sounds, it is partially their fault.

So, according to this law, the bar OWNER is to be at the bar every minute that it is open?
The way I heard the story, the patron had been drinking all day, but the night shift bartender wouldnt serve him, AND she let him sleep it off in the booth for a few hours.. when it was closing time, she woke him up and told him to call someone.. he claimed he had a ride, but other patrons witnessed him hop in his car and take off.
I am not claiming this is the truth, it is JUST HEARSAY!!

No there is no such law that states the bartender or owner are responsible for anyone's safety once they leave the bar. You people are about the most ridiculus idiots I have ever seen!

no there is no actual law.. but being sued is a possibility.. depending on the evidence the outcome can be bad for the owner or server..

Its the same way if you are in a private residence and let someone drink and drive.. sad but true..

Here's a question for bartenders or bar owners: If a customer is sitting at the bar all evening, drowning his sorrows in a bottle of Jose Cuervo, a little out of his mind because he's already drank too much, who decides its too much? When is it enough to take someones keys or make someone call for a ride. Or better yet, call a cab for them. If a bartender can refuse to serve someone because they've been fighting in the bar, why don't they stop serving the ones already too drunk? Is it because the bar owners want more money in their pockets so they don't care? Would they care if it were their father, brother or son sitting on the other side of the bar getting ready to leave and drive away drunk? Yes it would, they wouldn't let it happen. So why don't they stop it before it gets to that point. I completely understand that people who drink should own up to their own responsibilities but I also honestly think at some point the bartender should be responsible.

Yes the bartender can cut them off and make them leave. But by whatever means they leave is completely up to them after they walk out the door of the bar. Once they are out the door it is no longer in the hands of the bartender and no longer their problem. Yes some bartenders allow people to keep drinking for more money. Is it right? Maybe or maybe not but isn't for me to decide.

Btown Mom: Here is the answer to your question.
Ohio Revised Code Section 4301.22(B) states: "No permit holder and no agent or employee of a permit holder shall sell or furnish beer or intoxicating liquor to an intoxicated person."
