how can it still not be clear that booze isn't involved.cops can smell that right off the bat.and why or since when does a blood test take several weeks??? something is screwy here. or are they gettin' ready to screw mr.finch over.the hell's angel should've worn a helmet.too bad.

Whether or not the "victim" was smart enough to wear a helmet while riding a bike should DEFINATELY figure into the level of punishment the violator receives. Would it have been AS serious if the guy wore a helmet? When you don't, you have a "death wish".

I have to agree with poster JIm. Wearing a helmet and full motercycle gear is important to your chance of surviving. Why doesn't New Mexico get it? Make wearing helmets a law for both motorcycles and bicycles.

Finch has FIVE prior DWI arrests so I'd put money on him asking for a blood draw at the hospital and also put money on he was impaired either on alcohol or some type of drug or intoxicant. Just because you choose not to wear a helment doesn't mean it should be open season on you either. Finch has shown with his FIVE DWI's he's not responsible and you can bet his passenger who said he didn't see the motorcycle, wasn't sober either.

Very well said Landshark. Motorcycles are on the road, same as the bicyclists, it's a fact of life, people need to be cautious and watch for both.

Thankfully that's just an ignorant opinion and will have no bearing in a criminal court. From the content of the article we can conclude the biker was not breaking any laws. To jump to the conclusion that the victim had a death wish because he wasn't wearing a helmet is beyond the pale.

The helmet laws in Neww Mexico are very much in line with most states. Google is your friend.

After 5 prior DWI's a revoktion. This bastard should have been in prison. More proof to, "just a matter of time". SJC courts should also be to blame. Prayers to the victim and his family.

You are very ignorant. People die everyday even wearing a helmet. Even wearing a seatbelt.
"Would it have been AS serious if the guy wore a helmet?" How can you even ask that? Yes, it could have you dope. My father was killed on his bike by a motorist who was careless and did not yield like this driver. My father was in full motorcycle gear. He still died. Regardless, this could have been avoided. Carelessness caused this accident. "They didn't see the biker" How do you NOT see a motorcycle?? If anything, those people are the ones you should be watching for the most. I wonder, had this been your father, brother, ect...if you would still place the blame on him, if you'd still feel the same. My sympathy and prayers to the family for your loss.

What does it matter that he wasn't wearing a helmet? It doesn't make him a bad guy, it was a choice. He wasn't breaking the law. He wasn't the one that killed someone. This doesn't make him a "hell's angel" so don't pass judgement. He lost his life so ease up on him. It's amazing how people will talk about someone they don't even know.

People in this town drive like they have their head up their a$$ anyway! I HATE driving around this area, because people are such aggressive drivers! I have seen people kiss the butt of a motorcycle while driving and while sitting at a stop light! Why don't people learn how to drive, get some manners and respect EVERYONE on the road! Yeah the guy should of been wearing a helmet, but he knew that he was taking a risk by not taking one! But, the OTHER driver is also responsible because he knew he shouldn't of been driving on a suspended drivers lic. But, they don't care! I truely feel for the victims family! My thoughts are with you! For the guy who KILLED him, screw off and go be someones BF where you belong! I seriously think they need to lock up the beer section in stores, and you have to swipe your drivers lic to get back there. If you don't have one, OH WELL!!! For those of us who do drink and are RESPONSIBLE, then we will be that much more safe.

No matter what, Finch license was revoked and five dwi.He should of not even been on the road.Why dont people in that town learn how to drive.Finch should of been in jail and this would not of happend.Harry Irvin was the kindest person you could ever know,would give you the shirt of his back.My heart go's out to his famiy,you will be in our prayers.Just so sad and to soon.

I think it is high time they stopped killing us. Two out of three crashes, with fatality, involving motorcycles, are the fault of the motorist not the motorcyclist.
There should be testing when getting your drivers license that would make you aware of motorcycles, and if you could not understand that series of testing or pass the test you do not get licensed. If you pass, you have to sign something to the effect that if you kill someone, motorist or cyclist through your own stupidity,lack of attention, or illegal activity, that you to, get the dirt nap.
In this case the SOB did not have a valid license, should not have been driving, and should be charged with vehicular homocide.
Rest assured I am going to do everything I can to make sure the "cagers" can see me when I am on my bike. Noise nuisance, light nuisance whatever it takes. I would rather get a traffic citation than have my family get a death certificate.

I totally agree with this! These idiots are out of control. I think they need to pass a law that if you kill a biker while breaking the law,(failure to yield, driving revoked, DWI, running stop/red) you should get an AUTOMATIC 20 years in prison with NO PAROLE! If these jerks know they are gonna be somebody's b*tch for 20 years, they WILL look for motorcycles!!

"Hell's Angel" eh? Is that your opinion of everyone who rides a motorcycle? If so, you do not belong on the road yourself. These comments by dim-witted people really torch me! You are probably one of the idiots who drive around in a blind daze and cause near misses.

If nothing else, motorcyclists are fellow human beings. You could show some respect for the departed and compassion toward the family. If you don't know the facts, then shut the heck up!

Mr. Chief Bowels, it is evident that you need a bit more fiber in your diet or possibly large doses of laxatives. As your user name suggests you are totally clogged up in that area, and full of it.
Evidently you don't have the first clue about the Hells Angels. It is harder to get out, than in this club, granted they do their good but they also....you have no clue, so it is irrelevant.

Do not refer to Mr. Irvin this way.

As far as the Helmet, would not have done any good even if it was being worn.

Oh good grief another member of Chief Bowels' Tribe. Take the same meds as I prescribed to Bowels.
Lessen the charges because Harry was not wearing a helmet. That one definitely takes the cake.
