Mayor Powell say TIF acts need tweeking to prevent abuse.

Powell said TIF can be a valuable tool, especially for cities such as Arnold that depend on sales tax revenue for survival, but he believes the current TIF law can also lead to abuse and development disasters.

"I believe Arnold did it the right way because we didn't allow the developer to come in here like they did in Sunset Hills and offer contracts on individual properties and then back out," he said. "We offered a buyout program that allowed the property owner to determine when they were to get their money."

"One (property) owner cannot hold up redevelopment efforts. There has to be something built-in to the statutes that would allow a preponderance of the owners in the area to have some say. That's exactly what happened here. Fifty of the 55 property owners chose to sell for a very good price."

Powell's suggested change in the TIF statute does not sit well with Ron Calzone of Dixon, director of Missouri Citizens for Property Rights, an organization that primarily opposes eminent domain.

Calzone said Powell's idea would give those who want to sell their property power over those who don't.

"I'm somewhat amazed that the mayor would make such a statement," Calzone said.

"No number of neighbors or fellow citizens should have the right to force anyone else to sell property that they don't want to sell. Let's say that this was a car and that seven of your neighbors wanted to buy it. Should they be able to force you to sell your car?"

While Calzone believes that no one person should be able to hold up a much-needed public works project, such as a road, the same does not hold true with a shopping center.

"Obviously, under the current law, Dr. Tourkakis was not able to hold up the project," he said. "All I'm saying is that Dr. Tourkakis has the right to continue to own his own property."

Meanwhile, Powell said the city will pursue the condemnation of the Tourkakis property, which has been earmarked for a restaurant.

Since nearly 50 percent of Arnold's annual fixed budget comes from sales tax revenue, and given the sluggish economy, Powell said the city must be proactive in attracting new businesses that generate sales taxes to keep the city operating smoothly.

You know what amazes me is that the public stands quietly by and allows this to continually happen , but then again its the same public that spends 1/3 of there paycheck at walmart every week , supporting a company that openly abuses there employees ,towns that they are located in , companys that they do bussiness with, basically every one they come in contact with , In all reality the only difference between Arnold and Walmart is that Arnold right now is just to stupid to make money , so we justify stealing our residents homes and tearing them down so that we can build more stores , dont get me wrong , I love where I live ,but it sure is embarresing , when stupid crap like this comes up

You got that right. Arnold isn't know as the trailer trash town anymore. Arnold is known as the town with a Council that will take your home for their gain and call it "progress", spends money like it has an open ended credit card, will ticket you if you even thing about running a red light, will not let you smoke and that the residents don't mean anything to those who represent them.

Sorry CC,

This seem to be the same stance Mr. Powell has had since the first day that I talked with him about redevelopment after I was first elected six years ago. One owner should not be allowed to destroy a redevelopment deal/buyout deal for an entire area. This happened in Arnold about ten years back. Mr. Powell's opinion seems the same now as always. He is saying it must be done in such a way to make it as painless as possible on the people being bought out. In Arnold, this was done. Was it painless? No. But efforts were made to work with those being bought out, to get them above market value for their homes, and get them their buyout money an their timeline to help them buy new homes on their schedule and not the builders.

I read this comment by Mr. Powell to say all the method used in Arnold for the buyouts should be standard throughout the state.

Was there a vote of the people of the subdivision in a public meeting that had a show of hands how many REALLY wanted to be bought out? No. They were TOLD that if you don't take this that we will take it. That put those poor people under duress feeling like they had to sell. I bet that if you got them in a room today and asked if they really wanted to move, that the majority vote would have been no.
